PEB Hold of Cases with Adjustment D/O Diagnosis

All cases are on hold because of "Adjustment Disorder" on the
3947. We are still awaiting our guidance on how to handle these cases. It looks like they are returned but that's just the way we had to route them in EPEB to keep them on hold.

The above is a direct quotes from someone at the JBLM PEB when I inqured on the status for a few of my Soldiers

I just had a teleconference with PDA where they expressed concern about the push-back that they are getting from units and MTFs on Soldiers whose medical separation/retirements have been halted pending review of their cases for chronic adjustment disorder.

As a reminder, the Secretary of the Army HAS DIRECTED the PDA to cancel the separation/retirement orders on these Soldiers pending the review.

** Units/Soldiers do not have a choice in this matter. General Counsel has determined that these Soldiers cannot waive this review.** Please pass this on to your units and MTF CDRs.

Soldiers whose ETS date is nearing and who elect not to be extended for the review give up medical separation/retirement from the Army. They can still continue their claim with the VA, but they give up any medical separation entitlements from the Army.

MTFs are asked to provide WRMC PAD with the names and last 4 of those Soldiers effected by the review who have already begun termination leave and/or have already cleared the installation. PDA has indicated that they can work one on one with the Secretary of the Army to have these cases reviewed.
 
My ETS is Oct 2013, I'm in hold for the adj dsrdr and to be honest I'm tired of the waiting. By the time my window for terminal leave open this issue is not fixed I'm just going to ETS and move on.
 
I don't know about your situation but I think it's the wrong idea. I received my NARSUM the very day all this started. I thought,"Wow", this is moving along pretty good for the Army and all of a sudden, Wham! Hurry up and wait. The thing is, if you just give up and walk away you might not be able to revisit the issue and be screwed out of some benefits you or your familiy may need in the future. For all of the years, blood, sweat and general crap I have given to this Army, I'm holding on. They ain't gonna shake me off quite so easily and you shouldn't let them shake you off either. You've made it this far so what's another couple of days, weeks, or whatever. Hold on and get what you deserve, Signal Warrior. Get what is your right to have. Fight, please.
 
Totally agree with you boz48. Don't give up as if you ETS it will take even longer for you to get your VA compensation.

Team, ***CHRONIC ADJUSTMENT DISORDER***
FYSA from the DAG-1 LTG Bromberg....based on earlier NDAA requirement DOD has directed that CHRONIC ADJUSTMENT DISORDER (CAD) is now a disability condition that can be compensable by the VA. We are working thru the impacts on IDES and while we will slow down some Soldiers think we can work thru this wo major impact over the next 6 months. We have identified 1000 Soldiers with CAD rating thus far - expect another 2000 to be impacted -- MTF and exsum provides more details below.

EXECUTIVE SUMMARY: CHRONIC ADJUSTMENT DISORDER (CAD) NOW CONSIDERED A POTENTIAL DISABILITY -- IMPACT ON SOLDIERS IN IDES. On 10 APR 13, the DoD changed DODI 1332.38 to include CAD as a condition constituting a disability. This policy effects any Soldier not yet separated from military service by 10 APR 13. There are approximately 22,000 Soldiers in the DES who are still on active duty. Of immediate concern, are approximately 5,200 Soldiers who have received separation orders and are transitioning out of the Army. The US Army Physical Disability Agency (USAPDA) reviewed the records of these Soldiers and found that just short of 1,000 Soldiers (19%) were rated by the VA for CAD. These Soldiers' cases are undergoing detailed scrutiny by the USAPDA to determine if they require additional review by a MEB, which must render a decision on medical retainability. To date, the detailed screening indicates that approximately 20% of cases will require further evaluation by the MEB. To allow time for that evaluation, the USAPDA will need to stop many of these Soldiers from medically separating or medically retiring. Since the new DoD policy was approved the USAPDA has already stopped 74 Soldiers from medically retiring/separating and this number will continue to grow every day with an expected peak at approximately 200. The just short of 10,000 other Soldiers' IDES cases have moved past the MEB and are either at a PEB or the DRA awaiting ratings.

The PEBs will review these cases where they are and hold them until final approval of the new CAD policy. If statistics hold true we can expect the PEBs to return approximately 2,000 (20% of the 10,000) cases to the MEBs for clarification of CAD or other Behavioral Health diagnoses. This will create unanticipated work on both the MEBs and PEBs, and will negatively impact the timeliness of all Soldiers moving through the DES. Soldiers who are in the MEB phase (<7,000) can be readily reviewed and appropriate standards for CAD applied these Soldiers' cases will not experience significant delays. Timeliness goals will be negatively impacted for the next 60-90 days. Resources required to execute the detailed reviews for CAD have begun to create a backlog at points along the IDES process that will take from 30-90 days to clear. ASA(M&RA) has presented the draft implementation policy to SecArmy for his review/approval. PREPARED BY: COL Carl M. Johnson, Deputy Director, USAPDA, 202-503-7003.
 
I spoke with PDA yesterday (June 3rd 2013) and it looks like the EPEB are slowly starting to release soldiers packets out, soldiers still on Active Duty are taking precedence. That's all I have heard since and hopefully we will get a more detail answer soon. Also keep in mind that there is also roughly 150 soldiers been called back for Terminal Leave for review, so I will guess these soldiers will take even more precedence over anyone.

We have started getting cases back from the PEB that were being held there due to this.

So, all this might start moving forward again? Has the paperwork been signed saying how it would be rated? I am trying not to look a gift horse in the mouth but a few details would be lovely. Any help?
 
what are the requirements to be found unfit for CAD? what DOD rating percentages are you starting to see come back for CAD?

Yes, it is still on hold. An addendum has to be done and you have to come
in to review the addendum - will call you as soon as it is complete.
