Physical Disability Board of Review Update

I was retired on 7 Jan 10 and am dealing with the same type of issues you are. In terms of TRICARE, I am pretty sure that DEERS is all you need to be eligible for Tricare, I am contacting NPC because I am in the Navy but I am pretty sure that the process should be the same for TRICARE no matter what.

Does anyone know if the letter for approval for retirement will work to update DEERS fro Tricare, or do you have to have the updated DD214? The reason that I ask is, I do not see an updated 214 in the mail anytime soon but would love to have tricare.

Its to bad that Obamas proposal for retirement and va comp concurrent receipt was not approved, still only retirees with 20 plus years are eligible, such crap
 
Here is another update. I got a call today from a Ms Preston at the Army disability agency. She said the hold up was that my last transition point, ft wood, couldn't find my orginal discharge orders and wanted to know if i had a copy to fax to her. So I did fax her my copy. She called me 10 minutes later and told me she had the fax and she would take care of it and she would call and let me know it goes.

I heard from Ms Preston as well. I sent her all that she requested and now I wait to hear back.

I received my letter approving a change in my board results to 30% in October and I received my new orders that retired me in the mail last week. I had a connection at the local transition office and was able to get orders for me back in December. But to answer your question you do not need to have your 214. When you get your orders take them to the local retirement services office and let them know about your situation. They will than put in for you to have a DD215 to amend your 214. If it has been over a year since you were discharged they will need to do all of the updates on paper then submit it to HR so they can put it in the system. However if you have a copy of this request and your orders you can go to the deers office and get enrolled without waiting for everything in the mail. I have my retiree ID card and Tricare but I still have not heard from DFAS on how the pay will work out. Hope this helps.

You would need to argue/prove the unrated conditions were unfitting at the time of your PEB. Service connection is important but it does not necessarily equate to being unfit.
 
here is something new. yesterday I got a letter from National Veterans Legal Services Program. Basically the letter was an invitation to join in a class action law suit suing the federal government based on the fact that service members were Med boarded out for PTSD and werent given the mandatory 50% disability. The lawsuit covers from Dec 17 2002 to Oct 14 2008. I was unfit because of PTSd but got no percentage for that. Even after the PDBR I am going to join in the law suit.

" I have received all that I need now your orders will be
submitted to DFAS, and I am providing a copy to PDBR and then they will also
get in contact with DFAS. My copy is a courtesy copy. I believe that
the finishing process is going to take at least 3-4 weeks.

I thought this is where I started almost 3 months ago, but at least I'm getting some feedback.

Are you sure you were found unfit for PTSD. If found unfit, you should have received a rating even if only 0%.

Sorry it was rated at 0% for PTSD and major depression much to the chagrin of Major Ronald Johnson commander of the med hold at Ft. LeonardWood. He didn't think the unfit rating from the Behavior Med doc should be included on my med board. I guess in his infinite medical wisdom I was fit. I appreciate the opinion of a part time mailman. The med hold people there treated soldiers like they were trying to steal from the gov't. Nary a one of them had a combat ptach. The case managers and civilians were great. on my DA Form 199 those two issues were rated at 0%.
 
Update-- I called Mrs Preston this morning and she told me everything was completed. She mailed me a copy of my retirement orders and said she sent a courtesy copy to DFAS, but DFAS will have to wait for orders thru the proper channels before they can start working on my retirement pay.

I got my Orders on the 26th, so I went to the ID Cards office and my orders had not gone through St. Louis yet. They faxed them a copy while I was there and they were able to set me as Retired. After about 20 minutes I had my card. Everyone keeps telling me I'll get back pay but since my injury wasn't combat related, I don't see how I can get back pay. However, it would be nice!

[FONT=&quot]My name is Jonathan I’m a disabled veteran discharge from the Army in 2004 with a 10% rating for Fibromyalgia also had a diagnoses of Major Depressive disorder which the PEB refused to recognize in an effort to deter from me qualifying for disability retirement benefits. The PEB also disregarded my low lumbarschoriscal strain dismissing the even existence which was on the original PEB. I really need some help I mail application of to the PDBR and had a conversation with the intake coordinator Victoria in Randolph AFB, TX. I inquire about the use of just the VASRD in the rating process of the PDBR she state quote “the PDBR’s rating will not be the same as the VA” this very disheartening in regards to me to receiving a fair look at my claim. The documentation I provided to the board along with a letter from the doctor who wrote the narrative for the PEB with state that I had Lupus SLE at the time of discharge with lab and symptoms at the time of discharge but the board was rushed. At that time no Warrior Transition Brigade JAG counsel had little knowledge of the PEB process meet with him once very little research and time to prepare for PEB rebuttal or discovery of new evidence. I’m just one of many vets who want justice and the 30% medical retirement benefits that myself and thousands of other vets are due. I need help legal and vet support fighting PDBR to ensure I get the benefits that I’m due have no money acquire legal services on my own due to constant medical care which I have to pay on my own and the VA system is overburden due to the Army passing the buck. Just need a voice for justice (30% MEDICAL RETIREMENT) for us vets who clearly deserve it can just throw us away like the trash.[/FONT]

Does your move entitlement become restored if you become Retired most of us couldn't move anywhere we wanted how does it work now considering we all move to our HOR or locally to avoid excess costs fair is fair we are entitled to a move anywhere once retired?

That’s a great question. My Medical discharge order allowed for the Gov to pay for my move, and I only did a partial move because I expected to do 20 years and never planned on a Medical Discharge, so I still have stuff 2000 miles from me. Now that I've had some closure with my new retirement orders I can settle down. Also, my new orders say they government will move me but since my 6 months from my initial separation date is up, do I still get a chance to move the rest of my house hold goods and get reimbursed by the Gov?
 
I'm not sure how the CRSC will work out completely. The way i read it, I should qualify. My DA 199 and my disharge orders both state that my injury was combat related and caused by an instrument of war. I sent my application in today with all the pertinent info. Hope it works.
