Physical Disability Board of Review Update

Update:
-Docket #5
-Initial Application: January 16, 2009
-PDBR Washington initial receipt: May 2009
-PDBR then requested my full DVA records, which arrived September 18,2009
-According to my congresswoman's liason and the PDBR my case should be getting adjudicated as I write.
-As stated before Navy discharged in May 2008 with 20% disc degenerative disorder after 2 back surgeries in 2007
-VA rated combined 80% (50% sleep apnea, 40% disc degenerative disorder, 10% back scar, 10% tinnitus in both ears)
-Will disseminate results when I get then.

UPDATE, Docket #297 Original Application 7 April 2009, arrived at the adjudication unit 7 July 2009.

Called PDBR yesterday 9-23-09.

Spoke with a Mr. Espinola, he said the board has had my case in Washington since July 9. He told me I will hear from the board before he does. As far as he knows my packet was complete, and the board is not requesting anything.

So looks like we just wait. I will advise if/when I hear more.

Spoke with a Mr. Espinola, he said the board has had my case in Washington since July 9. He told me I will hear from the board before he does. As far as he knows my packet was complete, and the board is not requesting anything.

So looks like we just wait. I will advise if/when I hear more.

WHY does it seem like every one who call the PDBR IN TEXAS, get the same answer from a MR ESPINOLA? saying that veteran, will hear something before he,they at the PDBR in TEXAS do,this answer is worn out, i have heard it twice so far in 60 days, wHY HAS NO ONE GOTTEN A POSITIVE ANSWER BACK FROM THE BOARD AS YET?,ITS BEEN ALMOST A FREAKING YEAR, AND THE PDBR-DOD CANNOT COIMPLETE ANY ONE(VETERAN) REQUEST AS YET, VETERANS, LETS NOT HURRY UP AND WAIT, LETS PLAN OUR NEXT MOVE, BECAUSE SOMETHING SMELLS REALLY STINK HERE WITH THE DOD-PDBR, THE GOVERNMENT DOES NOT MOVE THIS SLOW ON ANYTHING UNLESS IT BENEFITS THE GOVERNMENT
 
I think whats happening is they are waiting for October to come around, the month the new annual budget is passed, then they can start passing out approvals with retro payments (happened to me last year and I have a feeling this year also with my VA appeals). I have a feeling thats going to happen. Hopefully im right, but if I'm wrong, this is typical PDBR/DOD so far at its finest.
 
I hope they are not waiting until October because i saw Uncle Sugar spend money on new carpet for a building being BRAC'ed in less than 2 years and spent over 60,000 bucks on civilian training.
 
Retirement money comes from a "pot of money" (a fiscal law term) that likely does not mean the delays have to do with the annual budget process. I don't think this is the reason...though I do agree that this process is taking longer than it should.
 
I met a guy today at the Rockford VA clinic who won his PDBR case. He sent me to this site National Lawyers Serving Warriors. You fill out a form and tell them whats going on. he had the retiree Id to freaking prove it. The represented him for free. Check it out I just fill out the form on the site, I guess even if they screwed you already they can get it for you. it is worth a try. So keep positive I now know for a FACT that atleast one of us got Justice and benefits. Take care to all of you good luck and have a good weekend. John

Hey John.

I already sent in an application and they said they will not be able to help me with the PDBR. They told me they can only help me with the VA, the LSW are so understaffed they cant work with PDBR or MEB/PEB cases. More like a blow off to me. If you get in let me know..
 
Called PDBR and was told no records yet. Called NSO at DAV and he said he sent records off and gave me a tracking number. Guess what they were delivered two months ago two days after I requested help from the DAV. I dunno maybe they are playing games.
 
WOW,againn the dod-pdbr is playing games, same answers to us(veterans) there MUST be a way for us to track the dod-pdbr activity, who supervise the board? what office of the federal government-dod, ovesees the pdbr? so far we as veterans has no recourse but to keep hearing the same crap from the people at the dod-pdbr in texas, who only gives us(veterans) lies and the runaround.its seem when it comes down to the dod-pdbr, we as veterans, are helpless and at the mercy of those, people at the dod-pdbr, there must be another avenue other than texas to call to check up on the pdbr

I know this is too simple, but are they subject to the IG (Inspector General). I mean if they don't follow their own policy, US Code, various DOD policies and regulations, and the will of congress, then what is the enforcement mechanism? I mean even my battalion commander was subject to the IG when he did not follow policy.

Also, can we get results and statistics from the board via an FOI (Freedom Of Information Act) request? Or do you think they will just answer a letter written directly to the board? I think that may be something to do down the road, once they finally get around to deciding enough cases to build a statistical history. (At their current rate that could be some time around FY 2015 )
 
Remember tomorrow starts the new FY2010. I fully expect more people hearing back from the board then. Hopefully, no news is good news but I am holding my breath on the issue. I remember back in the military where we were not allowed to spend any funds from July-September, but then when October rolled around we were good-to-go. I will be the first one to say it has taken too long, because I applied on January 16th with docket number 5, but I am willing to give them one more month to get their act together with the new budget funds in hand. Like I said back in May, whether they are willing to admit it or not, budgeted funds are making a difference here. If I don't here back from them by the end of October, I will be initiating my own blast to all parties involved.

I spoke to a nice man at Sen Johnny Isakson's office today about the Post 9/11 G.I. Bill backlog. I am going to ask him tomorrow about the PDBR and what is taking so long.
 
You were right Wil. They do not help us. why is it that VFW american legion and every other group like this law firm present that they help us but when we bring up the PDBR they slam the door on us like we asked them if they want a shot of AIDS.
I do not get it at all. nothing from my congressman yet on what they can do. probably nothing like everyone else. man I feel like I just got punched in the gut.

the dude at thew va who won his pdbr case, i wish he would get on THIS site, and let us(veterans) know how he did it, because according to randoplh in texas, no one has gotten back a retirement result as yet, so if you are out there and you have gotten back a positive result from the DOD-PDBR board, leading to a retirement, PLEASE dont be ashame to share the do's and donts of the PDBR, and how long before they respond to you, to include your pass dockett number
 
How would they know if anybody has gotten a retirement back yet? They probably are not allowed to disclose that information. I am willing to bet not to many people at all have gotten any result bad or good back yet.
