Presumptive Conditions CRSC

I was medically retired for Lupus (60%) and Fibromyalgia (40%). I received 80% DoD and 100% VA. I retired at 14 years and 6 months. My high 3 is in the amount of $4910. Spouse and two kids. Duty locations: Kuwait, Qatar, and Saudi Arabia.

1. First question is will Lupus and Fibro qualify for CRSC?

2. If so, will the percentage be the same as what I was given 80%.

3. How much would I receive?

Any help would be greatly appreciated!

1. Average high three base pay OR better, the GROSS RETIRED PAY from your DFAS RAS. State which.
2. DoD disability retirement percentage
3. Active duty equivalent (this info is found on your retirement orders as DISABILITY RETIREMENT xx years xx months xx days
4. VA compensation
— percentage
—amount
—dependents by category and age
—any SMCs ?
5. Did you have the blended retirement plan?
6. Approved CRSC percentage

5. No blended retirement.

Here is an estimate of your CRSC based on the info you provided.

a. 4910 x 75% = 3682.50 gross retired pay (this should be the GROSS on most recent RAS from DFAS)
b. Retired pay reduced to zero via amount of VA comp
c. 14.5 AD equivalent x 2.5% = 36.25% longevity multiplier
d. 4910 x 36.25% = ~1780 longevity portion of retired pay and a CRSC ceiling
e. 80% CRSC is more than 2000, so the longevity amount would be your CRSC
f. Your CRSC is the lesser / lower amount of the longevity amount and the CRSC % using the VA comp tables.
g: VA = 4335.16 (no spouse mentioned) each month
h. DFAS CRSC = 1780 each month

First of all: apply, regardless if it qualifies or not, let the service branch make the final decision. I would hate for someone to NOT apply only to find out that was in error. Taking that into consideration, I'm not seeing Lupus listed, but I do see Fibro and all three of those locations fall into it, below are snips taken directly from the VA's Presumptive List to include The PACT Act law:
