You don't elect which to take unless it is a special situation. It is automatic. At discharge, the service will pay you retirement pay until the VA finalizes ratings (few months) When the VA finalizes ratings, they will pay you whatever the rating equals on the compensation tables (tax free). This VA pay will offset(take away) the service retirement pay dollar for dollar that you are paid in VA compensation. If the VA is more than what service pay is, you get zero from the service. If service pay is more, you get paid the difference between the VA pay, and what the service pay is (taxable) It all happens automatically, and you don;t do anything.

To get back some of the offset pay that you lost, you file CRSC for combat conditions to your service CRSC board. Based on the percentage they award, you get some or all of your offset pay returned in the form of CRSC. This step is not automatic and you have to file.
 
So lets say I get 50% dod and 70%VA does that mean I get VA pay and still the benefits of being retired ?
 
Regardless of what your VA pay or rating is, Aslong as your retired with 30% or more you keep your DOD benefits ie, tricare prime or standard, base/commissarie access

I appreciate all your questions, but I am going to ask you to search a bit. These issues have all been covered in great detail, throughout hundreds of threads.

As for this question, when you are on TDRL and they do the reevaluation, you can either be found stable, and moved to PDRL, be found fit and returned to duty, or be found not stable enough and continue on the TDRL. You can stay on TDRL for a max of five years. After that, you are either found fit, or moved to PDRL if rated over 30%, or given severance if 20% or less.

TDRL is not automatic as far as your initial PEB rating. Again, if found over 30% you could go right to PDRL, less than 20% get severance, and can be found fit and return to duty.
 
You can be given severance upon the first TDRL reevaluation. The system is skewed against the wounded warrior. Under current law, once the unfitting condition(s) rates lower than 30% the member is separated with severance even if the condition is not stable for rating purposes and it is known it will get worse (even fatal) in the future. However, if the condition rated over 30%, one cannot be put on TDRL until the condition is stable for rating purposes and or five years, whichever comes first.

Now I am truly confused Mike. So you are saying that if the DoD (or DoN in my case) determines that my original unfitting conditions will be considered by them in my upcoming initial TDRL re-evaluation to be 30% or less I will receive a severance only(?), and if I am fortunate enough to be just over 30% after they are done reducing it (piecemeal or all) at their choosing, I can still be removed from the TDRL? What if one of my several conditions is unstable but rated below 30%, Do I remain on TDRL or do the "stable" ones that may help add up to or greater than 30% keep me on TDRL? I am currently 80% DoD for 3 conditions with one condition at 50%. The other two are below 30% each. If the 50% one is reduced to 30 or less am I looking at being removed from TDRL? The VA has recently reviewed all of my service related conditions and I am rated at 100%. However, the PEB states that the VA's information (Regarding just my unfitting conditions) is not sufficient for them to make a decision in my TDRL case so it has been suspended till I get an evaluation. Here is the kicker. I was given the option(s) to a.) Have a Civilian Dr complete all of the evals locally in my city, b.) Have a DoD physician do it at a local MTF, c.) Have a DoD physician do it at NMC San Diego (on orders) or d.) have the local V.A. complete it.
How in the hell does this make sense when I just provided them with the VA's very thorough review when this is supposedly an "Integrated" Disability Evaluation System?
Any insight to the madness will help ease my mind. Nobody seems to be listening especially the gatekeeper who is the Board Secretary for the Navy PEB at Navy Yard.
 
What is key is your combined DoD rating upon TDRL reevaluation. If that rating is less than 30% (0%, 10%, 20%) you will be separated with severance. The VA has effectively bowed out of TDRL reviews so TDRL reviews revert back to the legacy DES where the service does everything. However, they are required to review what the VA has done since being placed on TDRL.

I receive both VA 100% and DOD 75% did somebody screw up and am I going to end up having to pay money back?
 
I bet they will catch up with it and then take it back.
It's been almost a year. I called DFAS about it and they told me I was good, but everything I heard was that you can't get both. I'm 100% VA 100% DOD and DOD pays me 75% of my base pay.
 
If I were you I would bank the overpayment for when they finally figure it out.
