Re-thinking the whole situation. Any advice?

Hello all,

As a secondary to my first post regarding this situation, I have signed my med board paperwork and they have sent it out. When I first received the news of my findings, I initially thought that they were low, however, I really did not know what to do, so I signed the paperwork and med boards sent it out. The navy found me unfit -10% separation w/ severance, and the VA awarded me 30%. As I mentioned, I honestly thought that I would have received at least 30% from the navy and retired, and at least 50-60% from the VA. However, that was definitely not the case. The past couple of weeks, I have been thinking real hard about everything, and was wondering if I had any options to get higher percentages? I can't have the navy re-evaluate, but can I have the VA re-evaluate?

My history is as follows: I have had three different back surgeries since Feb. 2010; constant pain, limited mobility...etc. Long story short, Navy found me unfit -separation w/ severance, and VA granted me 30% disability. I fear the worse once I do separate, only because of the back issue. My back pain and leg pain honestly hinders my ability to do just about everything, it really does not afford me the opportunity to find gainful employment and I feel horrible because I can't even play with the kids as much as I used to, and I am sincerely worried about my family, I need to take care of them.

January 5th is my final day, but I think I really got screwed with the percentages from both the Navy and the VA. Any options, or am I stuck with their decision?

Thanks again to everyone for your help.

Brad

Well I know you can get VA rating changed. Especially if you have military records proving injuries happen in service. My friend went from 60% and now he is 80% through the V.A.

I have also been ratted twice through the V.A. second time they just sent me a letter saying they wanted to re-evaluate my 40%, which they agreed to keep my rating at 40% again.

Sexton, Im Navy as well. Originally rated 40% on my back, 10% on my hearing and )% on my hip. I just went through sitting with the ortho to get my % increased on my hip. Not sure how to go about the MEB/PEB but I know as for the VA you can have them re-eval you at any time. I called my rep that originally put my claim in and she ran the request, got a call from my schedualing guy and was on track within 2 days. You can go to the VA at any time. But the key is you have to tell them everything thats going on, if your having issues with not being mobile and stuff affecting your mental state, which Im having issues with as well, you need to tell them. BUT, and Im passing on what was told to me, if you file for connected depression, do it seperatly from your re-eval. Reason being that it can take longer because your adding to. So as I was told, do the re-eval and then when you get that squared away put in the claim for mental state. For me, I wasnt a jock or nothin like that but I was keeping up with the 'kids' while in my early 30's, and now I cant do anything. So as soon as I find out about my Ill be putting the claim in for mental issues. Sounds bad sayin that.
