Referred to PEB

So my package is at the PEB right now. Background: herniated disc at L5-S1, lumbar and cervical radiculapathy are the diagnosis referred to the board. Have other issues for the VA not related. I had a laminectemy and discectemy (spelling?) at the same time last June. I was put on a third period of LimDu which has since expired. I'm not waiting on ratings from the VA and DOD. My EAS is June 20, 2013, only 16 days away! They're going to extend me until the board is over though.

A few questions I have:

What will the board respond with? Is it just ratings or will they inform me of how much I'll be compensated with whether it's severance pay or retirement pay?

If I do get a severance pay and decide not to appeal, will the VA recoup it? If so, what exactly does that mean?

Any help would be appreciated. I'm currently looking for jobs but I'm not sure when I'll get out or how long this process will take. Should I be applying? I have my Bachelors in Criminal Jusitce (who doesn't?) and I'm halfway through my Masters in Public Administration at Penn State (graduate next May).

I am not trying to be a jerk, but everything you asked is already on here, you just have to search. That is a lot of information to repost.

All conditions are required to be covered in the MEB and considered in your fitness determinations. Don't let them sell you short.

Thanks Mike, I'll keep that in mind.

Joe, understood. Just hoping to get some feedback either way. I've been doing research but it's difficult to find a lot of time to do the research. I'll keep looking. Thanks
 
To piggyback Joe--your PEBLO should have provided answers to your questions via handouts and briefs. It's pretty basic stuff that you definitely need to understand. Take a look at your MEB/PEB handout again. Also, I would recommend getting over to see MEB Legal Outreach for a brief about the process.

However, I will entertain... :)...the PEB is going to determine fitness (return to duty or unfit for each claimed condition); then, PEB forwards your case to VA for ratings purposes. Thirty percent or higher on unfitting conditions means retirement, less than thirty percent means severance.
 
Thanks! I read through the packet I was given and have a pretty clear understanding now. Just getting anxious. It's only been three weeks or so. I'm ready to get out and move on.
 
His claimed condition should be part of his MEB/PEB, how else is the PEB going to determine fitness impact on all medical conditions as required by 10 USC 1216a? If your unfitting condition incurred in a combat zone, your severance will not be recouped.

I have finished my claims witht he VA. My paperwork was accepted by the PEB on 23 May 2013. I was told they have 120 days but have been returning them within 30-60 days. My injuries were not combat related. There were a few conditions I forgot to claim at the VA but was told I can add them later on. I'm hoping to hear back before August and if I agree, hopefully be allowed 90 days until separation/retirement and be allowed home awaiting orders. Not sure if the Corps still does that or not.

Not sure if this helps but I signed and returned my MEB NARSUM (dated 21 Mar 13) and received a copy of a memo (dated 12Apr 13) where PEB requested VA ratings for five "unfit" conditions and I'm still waiting..... Im guard though so may take longer.....Good luck.
