Reserve and National Guard Incapacitation Pay

incap sucks sorry u got to use it been on it for a year and some they wont give me regular orders. going to be on incap till at leat sept crazy stuff i just got paid for march april and may how about that not a quick thing every bill is late overseas for two years this is thanks love it
 
I apologize for not replying sooner and thank you for you prompt reply..

At the time, May 20th, that I was injured, I was employed. On May 2oth, I was injured durring drill, was sent to the ER that evening and released from ER with meds and told to return if pain did not go away after 2 weeks. I attempted to return to work on May 23rd and was told I could not and needed a Dr's release to return to work. I told my RNCO this and it took until June 15th before I received another appointment. I went to the appointment and the Dr issued me 12 Physical Therapy sessions. I took paperwork from that visit to my RNCO and waited.... The first week of July I received authorization to attend my 12 Physical Therapy sessions and after I went to my RNCO's office to pick up paperwork, I attended my first one on July 11th. In the paperwork I picked up was my InCap forms that I took home and filled out ASAP. Of course, since this was the first time anything like this had happened to me I was ignorant about some steps that needed to be completed and was not informed. Around July 15th I was contacted by my RNCO and was told he needed the "Military Physicians's Statement of Soldiers's Incapacitation / fitness for duty Form" that was given to me on the 15th. I did not know until he told me, at that time that the Dr I visited on June 15th was supposed to fill that form out. Why was I not given the form before my June 15th appointment?? I asked him this and of course him being two ranks above me, I get the usual answer. Anyway, to make a long story short and after contacting the Dr's office many times, I finally got the form filled out from the Dr today, Aug 11th. I now have to wait until Aug 15th to get ahold of my RNCO because he is on leave until then...go figure. So, as you have guessed, I have not received a dime as of yet and my wife is making preperations now to contact IG.

My employer fired me for excessive abesnces and one of the abesences was a required government meeting. I worked on a Homeland Security contract and was fired by my companies HR department, while my contract supervisor was telling me that there were no issues with my absences since I always put my 40 hours in but when my employer tried to fight me on unemployment, I found out during my unemployment hearing that my supervisor was telling the HR department that my absences were unexcused. My VP of HR was also very surprised during the hearing to find out that both of the absences used to fire me were for days that I was in the Fort Belvoir Army Hospital being treated for my injury and that my supervisor was fully aware of this and even sent me emails to tell me that there were no issues with those days missed because they were for a military LOD injury and I had provided the unemployment commission with thirty pages of documentation from the hospital and my supervisor for the days I missed and was fired for. Needless to say, my company lost and had to pay my unemployment. Looking back, I should have sued but being a believer in the need for tort reform, i choose not to sue and I was also misled to believe that INCAP and my MEB/PEB should all move quickly and that I shouldn't have any problems given the nature of my injury.... I am almost laughing to but it hurts too much to laugh....

And I started this job after I was de-mobilized from my sixth tour (three years with mobilization orders and three with TTAD, CO-TTAD and ADOS) and my employer sold me disability insurance and told me that my injury would be covered if I needed additional treatment down the road because of my injury but then found out they were wrong after my claim was denied as pre-exesting and no I was not given a refund because the insurance was still valid if I had had a different and new injury occure.
 
2) entitlement to active duty pay from the period you were dropped off of orders. If you are receiving incap pay now, this would likely halt the further entitlement to pay, but you may well have a claim for back pay.

ok, what would be needed to be done to file for that pay?
 
I was wondering if I am on incap pay, do I report to work at my military job? I have not been given any orders telling me to report to duty. I also work as a civilian at my National Guard job. I have been told by my military/civilian supervisor to report for duty in a military capacity even though I can not perform the same job in a civilian capacity. I was on medical continuation orders and working light duty at my unit. I went to see my dad out of state and they denied an extension of those orders because they said I missed appointments, which I did not. I also had doctor's notes saying that it was alright for me to conduct PT on my own for the time that I was gone. Does anyone have any guidelines to incap pay so I will know what I am to do. It seems none of the higher ups at my base have a clue.
 
You do not have to report for duty while on INCAP pay. You should look up the instructions for your service as each are different. If you work and receive any pay, you have to report that income which will be deducted from your INCAP pay. By working, you're saying you aren't that ill/disabled and I suspect your INCAP pay would be quickly revoked.

I am in the Air National Guard and do not know where those guidelines are that say I am not to work while on incap pay. Do you know where I could find them?

Learn to Google. Read and learn. You can work your civilian job but you must deduct the income and report it on the INCAP form. INCAP pay is for when you cannot perform military duties *READ* link I sent you!!! Contact your UNIT or HQ for INCAP guideline paperwork. You should not have received incap pay without READING and SIGNING several letters of understanding with instructions. They are in the back of the links I already sent you. inside is this: "I am not medically qualified for military duty while I have a (4) in my physical profile and will not participate in any
reserve activity for pay and point credit. When my physical profile contains any combination of 1, 2, or 3 with or
without physical restrictions I will be considered medically qualified for military duty. The fact I cannot perform my
special operational duties, that is, flying duties, marine diving duties, etc., has no bearing on my medical qualification
for military duty."
 
The ability to perform military duties is a different issue than ability to perform civilian work. This is shown by the fact that there are two types of INCAP pay entitlements- when unable to perform military duties and when there is a loss of civilian compensation due to LOD disability. Don't confuse the entitlements based on the two separate situations. Take a look at the INCAP pay provisions of this:

I have posted a few inquiries about the incap pay previously. Now I am off medical continuation orders and working at my National Guard base in an active status. Is this legal? I was told that after I have worked the normal two week pay period that I was to submit my incap pay paperwork to my civilian employer and then wait to be reimbursed by the incap system. I have asked my chain of command how it is that I am ordered to work with out handwritten orders and have also been told by the flight doc I report to that I am rated as a "4" on my physical profile which states that I will not be present for any reserve training or activities. I sent presented these guidelines to my chain of command and the only response I got was from my Chief saying that "You look like a welfare case" WTF??? I would talked with a Senator's office and they said they could make an inquiry which doesn't help in protecting me from a fire storm of harassment from my superiors. Any advice out there??

I'm a TPU 1LT, TC, US Army Reserves, currently serving with Civil Affairs unit in Grafenwoehr, Germany (7th CSC is my higher Command), and I still have persistent issue with Incapacitation Pay from 2008. Therefore, I apologize for bothering you with this inquiry, and please, consider it as informal. I do believe that my current upper echelon admin support did what they could in regards to time elapsed and delay in initial processing, however last time I asked I was told they are awaiting response from USAR G1 - I feel that more time elapsed from the beginning of this issue can only make it worse I'm trying to see what should or can be done in this matter. I will try to describe entire situation briefly, however due to complexity of issue it will still be lengthier that it should. Is anyone aware of a good POC somewhere out there for Incap Pay???
Last email I found for Incap processing branch was [email protected] but that isn't working now...

I am going through the whole incap process now. I was injured on Nov 7 2015 and today is Feb 24 and still have not been paid. I have submitted all paperwork to command. I am also in that situation about to lose my home because of false promises. It's always " you'll get it soon". The thing is, I have been on top of the paperwork getting it signed and seeing all the necessary doctors, but for some reason incap pay is not moving like I am. Something needs to be done. We sign our lives to protect this country, and the government is willing to put us on the streets even while still serving. I have Ben searching for all alternatives to help me get through rent and bills. US VETS is your best chance at anything. My rent is 1550 a month and they are going to pick it up for 2 months. Which ended this month. So what's next from here? I have a family and got my leg blown up on duty and this is how we are repaid. Smh. I have a very sore heart right now and tears in my eyes because I have to watch my family struggle with me.
