Results from appeals for V1 or V3 codes?

Hello all,
My DA199 came in yesterday with the three conditions and % expected, but clearly states none are combat, instruments of war or hazardous duty related.
Psoriasis
Cervical strain/DDD
R hip impingement syn/arthritis
The Psoriasis I the main issue, goes way back to being discovered on one of many Iraq trips, but is technically in the records from a CONUS hospital a couple weeks after a deployment.

Anyway, what’s the data show the prospects are of an appeal for combat on the psoriasis and hazardous duty (heli pilot night flying, lots of deployed time) for the c-spine?

Meeting with my barrister tomorrow, but figured I’d check in here and didn’t find much on searches.

TIA!

No expert here, but I'd look at tying the psoriasis to Gulf War Syndrome. There are plenty of studies that have found that veterans that served in the Arabian Gulf have a much higher incidence of skin/autoimmune issues, and skin conditions are a presumptive under GWS.

For the cervical strain -- do you know how you strained it? Was it in combat, or at least in theater? Those are the questions you'd need to answer in order for it to be combat-related.

Stress brings on psoriasis. To me it’s a reaction from acute stress much like someone’s PTSD, but physical. Not sure if that’ll go far with the PEB, but perhaps as CRSC seems to accept this at times. The neck; it seems I need one specific instance that was the issue, vs chronic combat time. I’ll let everyone know what happens. It’s frustrating. Overall I am bond lucky and blessed to have made it through what I have. None of this this retirement was anywhere on my mind, can’t believe it is happening.

What does your JAG representation say? My wife appeal to get combat related due to exposure for Chronic Sinusitis. Even with the Pact act already in play and it being a presumptive condition she was not awarded a combat related designation for the unfit condition.

The IPEB adjudicators gave me a V1/V3 combat code for my neck condition.
Not for the psoriasis.
Now to see how things shake out for taxes and CRSC some day.
Thanks for the info everyone.

You only need it for one unfitting condition to have your entire chapter 61 pension exempt from taxes. If that is totally offset by VA compensation then it really doesn't do you much good other than further evidence to submit along with your CRSC evidence to recoup any moneys lost due to losing out on your earned longevity pension.
