Just talked to my PEBLO yesterday. She said the PEB has received my packet and my proposed are 80 VA 10 DOD. When my 199 is ready I will be putting in for a formal PEB to have 1. Lower back DDD rated at 10% and 2. Right Sciatica rated at 10% as well rated as unfitting to receive 30% total from DOD. She informed me it takes 30 days to receive the board date and the board will be 30 days after that. She also said If i have enough supporting documents that legal can conduct a "drug deal" and get the increase with out even attending a board, this route she said takes about 2 weeks. What is everyone's input on the validity of this information? Also my unit is informing me the max leave I can take is 60 days including PTDY. With PTDY ill have just over 80 days. Is this information correct as well? or can I put in for the whole 80? And lastly when will I find out my "no later than" date? Do i turn in leave forms after this date is received?
From my experiences within the DoD IDES process, I offer the following feedback in support of your specific inquiry:
Q1. What is everyone's input on the validity of this information?
A1a. Hmm, I have read on the PEB Forum of some military service members in the DoD IDES who were successful with the "drug deal" and not having to request a Formal PEB hearing for resolution of that specific concern.
A1b. Please remember that the IPEB can't yield/issue/develop a DoVA rating; they can only adopt the rating issued by the DoVA D-RAS.
A1c. Therefore, for any "unfit for duty" medical condition, if a DoVA rating doesn't exist or if the DoVA rating isn't IAW the VASRD (e.g., low balled) then a request for a VARR submittalis the proper action for a potential resolution.
Q2. Is this information correct as well? or can I put in for the whole 80?
A2a. No, it's not accurate! In accordance with HQ USAPDA, a military service member is authorized a maximum of 90 days transition leave [e.g., up to 60 days for ordinary leave + up to 30 days for PTDY (if retirement applicable) + up to 10 days for military installation clearance] albeit a request for an exception to the aforementioned policy can be submitted to HQ USAPDA at anytime.
A2b. Yes, please submit a request for the entire 80 days of transition leave albeit I can't recall the maximum amount of PTDY authorized for soldiers who are given Disability with Severance Pay (DWSP); I believe it's 10 days?
A2c. In retrospect, I requested and was approved for 91 days of transition leave without any PTDY included naturally!
Q3. Lastly when will I find out my "no later than" date? Do i turn in leave forms after this date is received?
A3a. Upon placement into TRANSPOC-III for generation of military retirement/separation orders, your "not later than" date shall be known at that point in time.
A3b. Indeed, after completion of your final military finance/military pay office appointment, you should know exactly the total amount of military leave days accumulated order to properly select your DWSP date which should not exceed the USAPDA issued "not later than" date for official military separation from the U.S. Army.
More specifically in reference to Q3 above, the USAPDA will assign a "not later than" separation date that will not exceed 90-days after the completion of processing the final determination by the USAPDA. The Installation Commander, through the transition center, will establish a separation date within the 90-day window. The not to exceed 90-day window allow military installations flexibility to assign a separation date within the 90-day window based on individual military service member circumstances, but should not be construed as an opportunity to delay the departure of a military service member from active duty.
Generally, the separation date should factor in the total number of days required to clear the command, authorize permissive temporary duty (PTDY) for eligible active component military service members, and allow for the use of accrued leave (e.g., transition leave).
Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."
