Severance Pay Help

Hi everyone,

I was recently separated from the Army National Guard with a 10% rating for Major Depressive Disorder. I was awarded severance pay, according to a memo attached to my separation memo. This was on July 6. I have since called my NCOIC from my former unit, my state's Finance department, and my commander. No one has returned my calls. I did talk to my NCOIC once, and he gave me the runaround, saying that he needed to hear back from some MSG at HQ.

Why is this such a difficult process? I have the memo that says it must be done, so why can't they do it? Is there something more that I need to do? Who do I need to contact next? Should I hire an attorney?

Any help would be awesome. Thank you all for your dedication to helping our Wounded Warriors.

Need more information to point you in the right direction. Did you receive separation orders already or was this just the finding of the PEB? If they have not cut your orders yet, that may be the problem. However, if you are already separated, I would tend to think the problem lies with DFAS (though your State finance office may have not input the correct information to notify DFAS).

One issue, though, may be that DFAS may have not put you in for payment early enough in the month to hit the right pay cycle. Also, there may be some issues if you received any regular pay during July.

Hi Jason

I have already received the separation orders from my state, effective 06 July 2010. Along with them, I received orders from the Department of the Army that authorizes disability severance pay. Those orders were dated 1 June 2010. The last drill pay I received was 15 June 2010.

Thanks,

Jon

Make sure you file immediatley with the VA. If the VA rates this condition 30% or more you could have a good case to get lifetime disability retirement pay and benefits to include Tricare.

Mike-

Thanks for the info. I've tried to file online... twice... but haven't heard anything. Can I file for benefits at my local clinic? If so, what do I need to take with me?

Thanks,
Jon

Yes you can file at your local office, he will give you form to get the ball rolling with the VA. you will need any and all 214's you will need info on if it was a LOD (line of duty) accident or not, and any findings from the Medical board, plus a copy of your medical records.

Update:

Filed for benefits today. Went to my local VA Clinic, but they were about as helpful as an ear infection. The lady filled out a form and handed it to me and told me to mail it in along with med documents. So, instead, I filled out the VONAPP online and submitted it along with my DD214, LOD, MEB/PEB Findings, as well as my final med exam. Should I have sent in anything else? Is the current timeline still four months?

Thanks again for the help, guys.
