TDRL/ PDRL

Hello @00shoke00

1. As you appear to know, if you have 20 Good Years, you can receive a reserve/NG (Non regular) retirement once you achieve the age requirement.

2. You would need 20 years active duty (not points converted) for a regular retirement.

3. You will receive a disability retirement now, but that pay is offset dollar for dollar in the amount of VA comp. You can apply for a non regular retirement as you approach the age requirement.

4. You can receive CRSC for a DoD disability retirement—many do.

5. Longevity portion of retirement:
a. Active duty equivalent (16 years?) x 2.5% = longevity multiplier
b. Average high three x longevity multiplier = longevity portion of retired pay and a CRSC ceiling

6. Approved CRSC percentage rate: use VA comp tables for same percentage with applicable dependents = CRSC amount for percentage

7. Your payable CRSC is THE LESSER (LOWER AMOUNT) OF RESULT OF ITEM 5 AND ITEM 6

8. If you have residual retired pay (left over from the offset), it reduces the amount of CRSC payable).

The RO is mistaken.

Hello @00shoke00

This is an addendum to my previous answer.

8357 X 70% DOD = 5850 retired pay
5850 retired pay minus 4,950 VA amount = 900 RESIDUAL RETIRED PAY YOU KEEP

5. Longevity portion of retirement:
a. Active duty equivalent (16 years?) x 2.5% = longevity multiplier ADDED: 16 x 2.5% = 40%
b. Average high three x longevity multiplier = longevity portion of retired pay and a CRSC ceiling ADDED: 8357 X 40% = 3342.80

6. Approved CRSC percentage rate: use VA comp tables for same percentage with applicable dependents = CRSC amount for percentage

7. Your payable CRSC is THE LESSER (LOWER AMOUNT) OF RESULT OF ITEM 5 AND ITEM 6 ADDED: PROBABLY ITEM 5 amount 3342.80 minus 900 RESIDUAL RETIRED PAY

8. If you have residual retired pay (left over from the offset), it reduces the amount of CRSC payable). ADDED: 3342.80 minus 900 residual retired pay = 2442.80 ACTUCAL CRSC

ADDED: DFAS will pay 900 residual and 2442.80 CRSC (separately). You will also receive your VA compensation
Notes: This estimate is based on the info you provided. Two percent is used instead of 2.5% if you were in the blended retirement program. The computation could be different depending on the CRSC percentage approved. Also, common errors in providing necessary info: incorrect average high three base pay;
incorrect active duty equivalent

So after reading about 20 threads on here and watching YouTube videos, I'm still lost....

I will say I am very displeased at my entire medical retirement process, from the lack of Army personnel not knowing how to advise to the PEBLO to the Retirement Service Officer.

Army/ National Guard
Captain /O3E
Spouse /3 kids (under age 18)
20 Years Total Service
16 years Active Duty (5816 Points)
70 % DOD
100% VA ($4,950)
High 3 $8,357
CRSC packet submitted (Probably get 100% CAB/multiple deployments/PACT Act

The RSO said I would get retirement immediately since I'm in the Guard with no offset since I'm over 15 years active and more than 20 total and over 50 with VA. I really don't think she is right, hopefully I don't have to wait until age 58 with deployments to draw DOD retirement.

Any help that anyone can help with is much appreciated. A dang shame we give all to the military and when we leave, we just thrown to the side.

How did it work out for you? I am in this situation now with 16yrs Reserve and looking at Chapter 61 retirement

I got 100% CRSC which is $3,150 a month and I get all of my VA. I receive nothing from DFAS even though I retired at 70% DOD and it says $5,378 a month I see none of is because Length of Service cap.

What if he was 19 years
Hello @Ynick7 ,

If the DoD Disability rating is 30% or more, they will receive disability retired pay that will be reduced by the VA COMPENSATION AMT. They are not eligible for Concurrent Receipt, but might be eligible for CRSC.

Less than 30% DoD = disability severance pay with no retired pay.

Both cases = full receipt of VA comp, but there could be a recoupment of some or all of disability severance pay (from the VA comp) if it (severance pay)was received.

Ron

A few conditions require a future exam. At 19 years things change. Specifically you lose concurrent receipt.

You don't have 20 years of active federal service (AFS). Currently, you are not eligible for CRDP. This is Memorial Day weekend and we should give the highest honor to those who have given the ultimate sacrifice. Please contact your congressional leadership and tell them you support the MAJ Richard Star Act. You stated you have combat related disabilities. This will help you and others who are Chapter 61 retirees who have less than 20 years AFS to receive CRDP. We can change the paradigm. Contact your congressional leadership and demand justice!
