TDRL Re-Evaluation

I was just informed that I’m up for my TDRL reevaluation. I was placed on TDRL in June 2020, so this is my first and only reevaluation. I was informed that the PEB will review my VA records and make a determination from them instead of scheduling an appointment at an MTF and having an evaluation that way. I’m not sure how I feel about this. I don’t have the opportunity to undergo an eval and share my thoughts. Are they really going to carefully comb through my records or just skim them and make an ill-informed decision? Can anyone share a similar experience? Any thoughts on the matter, positive or negative?

I was put in TDRL in March 2020 and never heard a word until 5 Months before my TDRL expiration, apparently due to COVID, did a phone appointment with a doctor from the local MTF, and everything has been submitted to PEB and now waiting on results, as for what theyre lokking for i dont know, my phone appt was just a "how have you been since being put on TDRL" and that was it. Its got me wondering what they do myself.
 
(Navy-specific) SECNAV instruction says re-evaluation will happen at either an MTF or VA facility. Further SECNAV policy directs PEB to take VA records into account whenever possible to minimize impact to servicemember and medical facilities.

Basically, this sounds exactly right. I would expect they (PEB) would give the records the same level of scrutiny regardless of where they come from. No reason to think otherwise.
 
Thats messed up cause i had to wait 2 months for a re eval appointment, i could have easily of given them any records they needed and sped things up some

Yeah, a lot depends on what the condition is and how good the notes are. I'm not a doctor, I don't know all the rules, but they have a lot of doctors working at PEB so I assume they have a system for determining what is good enough to do a determination and what they need more info for.

Do they already have my VA records or do I need to send them? I just haven’t seen anyone have a records review as opposed to an actual appointment. I’m worried that they aren’t actually going to thoroughly read the past 2.5 years worth of notes since I’ve been on TDRL. I’d just like to hear from others who also had a records review.
 
They ask me what VA hospital i went too but never had me sign a records release or had me get them, so idk how they do it.

They have access to them via electronic records systems. No records release needed. It's all one shared system now, more or less.
 
Oh !!!!! I figured i be getting a letter in mail or email for records release, didnt know it was interconnected like that. The only thing ive gotten since re eval is a letter with my re eval assesment and a unfit for duty determination.
 
So from what I hear, due to the TDRLs of all the branches being Congressionally mandated people that work at TDRL(s) have full access to your VA records for that exact reason. They will only use your VA records if the VA examination specifically addresses the medical conditions that prevented you from continuing to serve, the condition(s) listed on your DA 199. More specifically the condition(s) with an "N" in the d. column (meaning that at the time of the MEB that condition(s) was found to be unstable-hence your placement on TDRL). The Navy, no shade intended, is the furthest behind in TDRL cases at the moment. IF they use your VA examination and you are unhappy with the resulting percentage given it is your right to appeal that decision. Just make sure you keep in contact with your PEBLO and answer any phone calls/emails from them quickly, because once the PEBLO receives your final DA 199 from the PEB you have 5 days to respond with concur/not concur (and elect for a formal board) or else your case will be considered an automatic concur. IF you have to get a re-exam that would be an opportunity to address any changes in the conditions listed on the DA 199 at that time, but again you will have a chance to appeal any decision from the PEB just as I mentioned before.
 
I see, i know every other doctor ive gone too has a really hard time getting my VA medical records because the VA dosent just hand them to anybody, i didnt even know they had full access to it all until now, guess i waoted around for nothing
 
As for going through VA records with fine comb i dont know how they do it, im sure they have their own seperate ways of doing things, and protocols they have to follow, like attending appointments on time, getting meds refilled on time, any lapse in treatment, divorces, marriages, jobs, school.
 
Had my reevaluation done early January, how long should I wait before I reach out to someone? Any ideas of what I should be expecting timeline wise? @PERS-95

Are you Navy? And how long have you been TDRL?
 
So your timeline is looking pretty good. The way it works is that when you go to your reevaluation exam, the medical admin office at the clinic or facility that you went to is supposed to send your results directly to PEB. The vast majority of time they do that, and then you get a reevaluation done through PEB within a few months. The timeline changes a little here and there, but it's typically 2 to 4 months, maybe. Occasionally, not very often at all, the medical admin office forgets to send your records in. In that case, PEB doesn't have anything to do the re-evaluation on. If you are concerned that may be an issue, you can reach out to the MTF or the disability office, the guys who set you up with the appointment in the first place. But you are still in the reasonable window for PEB, so I might give it one more month. Either way you did it, you would not be wrong. Unfortunately, the Navy does not do PEBLOs for people going through tdrl reevaluation, so you have to advocate for yourself.
 
While you were in thervice did they set you up with the Navy Wounded Warrior Transition team for your region. If not contact the Navy Wounded Warrior, not Wounded Warrior Project, Navy Wounded Warrior. They should be able to help ya out with expiditing things if necessary

NWW cannot sign you up or advocate for you if you are no longer an active service member, if you did not have a pre-existing relationship with them from when you were in service. If you have already retired, and they don't already have you as a constituent, they cannot bring you on board.
