Hmm, I am not quite comprehending your situation with the DoVA!

To that extent, are you currently in the DoD IDES MEB/PEB process at this point in time? Are you assigned to a WTU?

What does not having surgery having anything to do with a DoVA C&P Examination for a medical condition?

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

mikejess88,

There was one soldier that had a similar set back, we served in the same Trp, he went to the VA C/P Exams was told that he hadn't done enough for the injury and evidence was inconclusive, come to find-out he turn down surgery and it came back to bite him. They stated that he refused to continue with treatment; he ended up going thorough the MEB process and there wasn't sufficient evidence for un-fit and was returned to duty. His case manager was upset as well because this information didn't come out sooner, it could have been screened for another opinion, before moving forward.

Hmm, an unfortunate turn of events which seems to have been to the advantage of the DoD during the military service member's IDES process! :(

Indeed, never give the DoD an opportunity to potentially use any medical evidence against you! As such, always review your military electronic medical record periodically for accurately documented healthcare treatment!

To that extent, rectify administrative medical issues immediately if the medical documentation doesn't properly reflect the medical condition’s situation.

What I ran into is that I was up for back surgery and the navy said I didn't have enough time to recover before I was going to get out so they sent to peb so my medical condition could be looked at.. I have enough doc stating my back is messed up but the va doc was just pissed that I didn't have surgery so she was making a big stink about it to my dr which made me look bad like I wasn't aware that I couldn't have surgery while going through the ides process she was just bitching to the dr about it trying to make him do it now cause with the va it would take about a year before I could have it done by the va

Okay, indeed, it's still unfortunate with the actions of the VA C&P Examination clinician in my opinion! :(

Hopefully, your medical condition and its symptomatology is well documented within your military medical records so that the DoVA D-RAS can provide the proper proposed rating.
