VA exam Question.

Just finished my last VA exam yesterday. Bad news is the va doctor said that the va has record of me getting into a car accident a couple years prior to entering my military service and he said he thinks it’s possible that the car accident caused my seizures and migraines that I’m currently having. I couldn’t recall the accident. I’m currently AD Air Force and work on Fuel Systems maintenance so I deal with hazard chemicals and fuel daily. I’m hoping when I get my proposed rating that they don’t blame it on an accident years before service. Should I wait till I get my rating to act? Or should I have my neurologist write a letter of his medical opinion.

how long have you been in? If the accident happened while on active duty then you are fine. While active duty they own you and anything that happens is service connected. Now if something is preexisting prior to service that could be an issue. There is an 8 year rule so even if it was preexisting you are fine if you have been active duty for 8 or more years.
 
I’ve been in for 3 1/2 years now. The accident happened 3 years prior to joining. They said I had gone to the ER for a concussion but discharged same day.

ouch. so that could be a problem. You might want to hire a private attorney. You can still fight to have it count by doctors stating that the conditions are permanently aggravated. Also, you may be fine. Its very hard to connect conditions to a direct cause so there is some room for interpretation.

Should I wait till I get my proposed rating?
 
I’ve read that the chemicals and fuel that I deal with in my job can cause neurological conditions. Would this help my case?

It could but that is why it would be wise to consult a private attorney. They can at least tell you if they can help and if so the cost and steps you would need to take.
