VA Rating 10 yrs later MEB/PEB

Hello All,

Will the MEB/PEB reopen my VA rating from 2013 that was finalized in 2016 as P&T IU and subject me to C&P exams again?

Until recently I was under the impression that as long as the rating was PT the findings would remain the same unless a request to add/change conditions was made by the veteran. I am now headed to the MEB/PEB process at 19 yrs 1 month Army Guard time (points) with ~6 of that time active. I have had many different answers to this question recently all without finding regs guiding the new IDES rules.

If you choose IDES they will do the examinations all over again. However, if nothing has changed there isn't much of a risk. If you go the LDES route they won't use the VA. However, LDES doesn't have the same protections as IDES. The military can rate the condition however they like and aren't bound by the VA ratings.

Thank you very much. I am tracking. No one in my unit has mentioned the option of the legacy path. My conditions are all the same or worse depending on the category. Coupled with consistent regular VA care, I do believe my rating will remain via IDES. It's just extremely mentally taxing going through all this again dragging up all that history while having the feeling of risking my rating.

With the IDES system using the VA ratings, will the considered conditions match one for one with the VA and DoD? I understand only conditions that DoD considers unfitting will be considered. Say my mental health is VA 70% will DoD them automatically be 70% if they consider the condition unfitting?

Yes. Any unfitting conditions rated by the VA will be the same % for DOD. So if rated 70% for PTSD and that condition is unfitting your DOD% will be 70%. That is a HUGE improvement over LDES. In the old system the military would rate that lets say at 30% for DOD and then when the Soldier got out and was rated by the VA it would be higher. Also, there are many more protections with IDES. Too many to put in this post:) The good news. The process of IDES is pretty streamlined and most have all their VA appointments done in a short amount of time.
