What have I missed??? What else do I need to do?

Ok finally after almost getting to the NARSUM stage on one last year MEB the Doc cancelled it as they found many more disqualifying issues during the med appts that we were not even aware of. I did not even know I had sleep apnea. 2 sleep studies later and apparently I have a severe case if it, I just don’t snore tho!

A couple more surgeries and several more diagnoses confirmed and my NARSUM was completed and sent to Seattle last week. Is there anything I should be doing now while I wait to see if I am unfit? (no worries about that tho!) Anything I should be preparing for when it comes back and then gets sent up for rating? I was just informed I should have already applied for SSDI so I am off to do that this week. I really should have kept up on this site more than I have, but life took ahold and ran away with me.

Also, a new severe issue just cropped up that did not make it in my MEB. I was recently diagnosed with Hypokalemic Periodic Paralysis of unknown origin. I have gone completely paralyzed up to my chest twice now both time requiring hospitalizations. I only partially understand that I will have to file this with VA after this IDES is completed. That means if I already get a 100% rating this will just get stacked on top. If I don't get 100% then this will be used to bump it up. My VA doc made mention of it in his report so it can be included with no surprises, but it was not listed as one of my rated conditions.

Anything I missed? Anything I really need to be doing while I wait that I don’t even know about? I have been placed on limited 8 hour duty, no night duty and no lifting. I am basically chair bound and of I get severely weak and the paralysis sets in again then I either go get admitted or go home to try to keep it from going full bore. My unit is a dream so I do not have any of that stress to top all my medical crap. If I can’t make it in to work then they understand. They also know I am not going to call out unless I am heading to the hospital. I refuse to abuse their graciousness. I will not go down being known as the guy who shammed his last while in the Army. I still get paid so they are going to get 100% out of me. Well ok maybe not 100% of my body, but they still get my brain and effort!

Make sure you read up on the posts for submitting for SSDI, there are some big things out there this week I did not know about. This info will really speed up your process!!!

Keep up on your appointments for the new diagnosis and ensure they are put in your medical records, that way you can make the claim the day your out of the military. The earlier the better!;)

Anything you could point me to as being the most important this? I just did the online application, so I am at the very beginning stage. Anything to make a GVM'T challenge go more smoothly is much appreciated!

DX are in records, which I have in hand and on digits many different ways for ease of access no matter where I am. I have to get some recent films and MRI/CT's on disk but other than that I am well documented so the day after I am out I can file them. It was just odd my first MEB attempt was cancelled because of "new" "worse" conditions discovered during my MEB, then the second attempt "new and even worser" issues crop up! I understand not halting this board to include them as this could have gone on forever but I also know adding them when I am out may be a long hard process.

All over EVERYWHERE for someone who has gone through the situations I am going through so I can look for what to do...and someones going through the same exact thing at the same exact time?!?! Wow. I am also on restricted duty hours, anything PT is a no-go. I started having paralytic episodes in Feb 2011.

Strange to find this post. I have similar symptoms beginning in 2009. I was initially diagnosed with Hypokalemic Periodic Paralysis in the ER, but the later docs said it was so rare that it was unlikely, but after a million tests they kind of shrugged their shoulders and walked away. They just restarted the MEB process on me after kicking me out without benefits in 2011 and then proceeding to lose the paperwork.

Can you clarify that statement please, it's not making much sense...
 
They chose to discharge me without benefits at both the informal board and the formal board, stating that my symptoms were incompatible with military service, but since they did not match up to a VSARD code, they did not give me a retirement. I appealed to the SECAF, after 6 months they recalled my package. The hospital lost the paperwork, I PCSed, a year later they realized that my MEB was never completed so they re-initiated the process recently.

It still doesn't make sense, you said your were seperated from the military, did you enlist in the reserves? Or are you saying that they elected to give you a severence and you somehow were over looked and still serving?
 
My case was recalled from a SECAF appeal, but the AF medical system has such poor control of paperwork that they completely lost my case, I did not receive severance, I was not discharged, I continued to serve as if nothing had happened, but they finally realized that they lost my case and just recently began the whole MEB process anew.
 
Oh wow, they screwed up big time. I'd say an IG complaint is warranted on this... You should also report the personnel on the ICE system, along will reporting it to Patient Advocacy, MEB JAG and anyone else that you can. I'd even report your CoC all the way up to BN/BDE levels, for letting you PCS illegally while in MEB. You were never supposed to PCS, unless it is to come back to the states and finish it out here.

On the other side, have your injuries gotten worse or have you gotten new ones? This will effect your case in a big way.

Not sure I have much helpful to add...it is apparent that they screwed up the processing of your case. However, if they have not separated you, technically you are not out any money (100% of base pay and allowances beats even the best outcome from DES- which maxes out at 75% of retired base pay).

Downside- the uncertainty of your future and not having final resolution of your case. Also, the angst and frustration with having been overlooked. I have a slight concern with there being a possibility that your continued service (if successful) might work against finding some conditions unfitting. But, if you are clearly unable to perform, this should not be a big issue.

Upside- you should have more evidence and time to document your case. Also, the longer you are in, the larger your retired base pay or service for severance calculation.

Not sure what an IG complaint or other complaint could accomplish. Unfortunately, there is no way to go back in time and have your case done right. Best you can do is to stay on top of your situation, advocate for your position and fight for what you deserve.
