Where do I begin?

I have been in the Air Force for 10 years. Two years ago I was diagnosed with Asthma and had to go up against an MEB. I was able to be fast tracked and was returned to duty with a C-2 code. I am required to have a RILO done every year. This year my RILO came back and I was returned to duty with the same C2 code, that was in April. Mid March I got orders to go overseas but I have to get a waiver to go over there. So, from this point all I have to do is see if they would waive me. Or so I thought. The middle of April I got to work and I am told that I have to go see the Assistant First Shirt. At the meeting Assistant Shirt is asking me questions that a remarkably familiar to the ones that were asked to me two years prior. I spoke up and asked why I was being ask MEB questions. He said oh, it's because you got orders. I stated that RILO was just done and I was told that my PCM would have to clear me here and the hospital at my next base. Why am I being asked questions. I was basically told that someone asked for it to be done. At this point and time I have yet to hear from my PCM or a MEB Liaison to let me know that "someone" is requesting this to be done.

A week or so later I get a call saying that I have an appointment with my CC regarding the questionnaire I answered and that they wanted any profiles that I had all the way back to 2008. I call Force Health and right off the bat she asks me if I want them for leadership. I say yes and she begins to explain to me that my First Shirt called and tried to get my profiles. She stated that they were told that they cannot request to see anything that is part of my medical records. Red flags went up because no where in the conversation with my Shirt was I told that they were trying to get copies and were denied them. So, they basically wanted me to get them for them. I immediately called the MEB Liaison to find what was going on. I am being told I am not being MEB , its just part of the waiver, if so why are my CC and Shirt involved regarding a medical waiver, their not doctors. Well, the liaison tells me that my Shirt called her also to try to get a hold of my profiles and she told them that she cannot give them to him. He was also tried to contact a Colonel (not too sure what his title is) and that he didn't want to speak to my Shirt because the individuals records that he were requesting was not his.

I was giving the number to Colonel but his secretary said he was on leave for the next two weeks to discuss the matter. The liaison told me that all she needed was a letter from my CC and my most current profile and that she didn't understand why they were trying to get a hold of old profiles that are no longer active. At this point I am still being told it is in regard to my assignment. At this point I have come to the conclusion that they were trying to look for something, why else would you need old profiles when all that was needed is the current one I am on.

I go to the meeting and low and behold they have a copies of my profile. The Shirt makes sure too state that the CC can ask to see my old profiles according to a reg. What reg I am not sure because it was never told to me. If anyone knows please let me know because I find it strange that the individuals in the hospital (Force Health and the MEB personnel) were so against it. They were upset that after my Shirt was told that he doesn't have permission to any information other than my current profile that he tried to get me to go get it. I would assume if no one else knew anything about the release of records it would be them. But supposedly there is a reg.

Let me get back on track. So, they are going through my profiles and they ask why I was on one in 2009. I told them that I was put on profile after a car accident and was sent to Physical Therapy. My back issue has been in my records since 2009. I has never been an issue for me to face an MEB regarding this. A week later I just so happen to go see my PCM and she lets me know that someone called her and told her she needs to look into my back issue. That only person that has known about my back issues are my PCM and myself. So....who could of called? She tells me that if I am on profile for my back I will have to be MEB'd. I'm not on a profile for my back... no worries right. WRONG!!!!!
I get an e-mail yesterday (a week later) and I am now being MEB'd for the asthma I was returned to duty for. Nothing has changed in my diagnosis, no new meds, no dosage changes....nothing and guess what the second thing is.... MY BACK.

I immediately call the MEB Liason and ask why I am facing and MEB for asthma when I was returned to duty for just last month and my back is now an issue when I am not even on profile or any type of limitations for it. Now I may lose my orders. Everything about this situation seems so shady and underhand. I don't know where to start to fight this. One plus one is not equaling two. I have a nagging feeling that something is not right with any of this. Hopefully this makes some type of sense, I know it is a lot. Any help would be greatly appreciated. Sorry for any gramatical errors, I am typing and falling asleep.

I cannot tell you why they may be inquiring about your medical records. You are right to proceed with caution on why someone who is not allowed access to your records is requesting them.

I was put in a similar situation with my command (Coast Guard) where my supervisor (Not the CO) was asking me to bring back every shred of evidence from every doctor's appointment I ever had. He had a "feeling" I was trying to "milk" my light duty, and was not satisfied when the doctors would not return me to full duty. He apparently thought he could review my records to determine my fitness. I didn't know I wasn't supposed to give him my records, it's really intimidating when a higher up asks you to do something like that. You feel like you should follow the orders, but something didn't feel right. Long story short, I was lucky and had friends working at the medical office. I asked what was appropriate documentation to give, and they told me NO ONE should be asking for my medical records, and that the doctor's light duty note would have to suffice. So after I sent an email to the medical office with the Senior Chief cc'ed, my doctor (who was a Commander) professionally slapped my supervisor's hand. Later that week my supervisor told me I did not have to provide documentation to him or anyone else, and that the Commander would be giving him all the information he needed to know. It was good to hear that the Commander and medical staff were protecting my rights, because I'm sure this thing happens a lot. Some people aren't as lucky.

I have seen this happen so many times where the command gets testy when their people can't perform full duties and try to find ANYTHING to get them out of their command. Don't let this stuff discourage you. People are breaking the rules, you need to keep up having the guts to call them on it. Don't be afraid to question their motives, get your head in the regulations, and bring it to their attention. If all else fails, call the medical staff to see what the rules are on giving out information. I hope it all goes well for you and gets worked out!
 
Setup a JAG appointment and get info from them.
They are schooled in the regs you need to fight it.
All else fails? Use ur right to appeal in the MEB process!
