Preferably vets who have first hand experience with CRSC claims with PACT ACT. How did it go? Did they grant or deny? What did you claim? Reason for grant or denial.
I am getting ready to wade in the CRSC arena. I am so used to fighting, that I feel weird when there isn’t a fight such as my most recent and maybe last VA claim. They treated it as a supplemental and labeled it such which is wrong. It was a new claim for new not previously claimed conditions. That’s literally the only issue, and really a non issue. Claim was decided in about 110 days. So this is my first claim not backlogged. They granted more than I was expecting, so I am not appealing. I am already 100 P&T. I also was granted medical retirement 5 years retro PDBR. Also won a a long appeal that went to the BVA went from 20 to 100. So I am used to fighting, but also prevailing.
I submitted an Intent to File about a year ago when the doctor said rhinitis after complaints of breathing knowing that’s a pact presumption. Months later got a CT scan. Sinusitis. Submit the claim within a month of the CT scan. Less than 2 weeks and I am having a C&P for sinusitis and rhinitis. I didn’t think they would grant rhinitis. Thought I would get low balled sinusitis, like 0% or 10%. When I got the decision 30% sinusitis and 10% rhinitis. The letter says “has been awarded on the basis of this presumption. Cites all the Pact boiler plate CFRs and USC. Shockingly easy claim.
Now I am looking at what my intent of this claim was in the first place, CRSC. Seems presumptive claims can be tricky. I am reading to select IW not GW for example. Any insight and advise is appreciated. I plan to package a complete claim up nice and neat.
