ANG OTOT AGR over 18 years TAFMS How to be med held?

Hi, I’m over 18 years TAFMS. Order is set to expire in September. It’s OTOT Temp AGR.

I’ve been all active duty service starting in USAF AD. Transferred to ANG for a personal matter. Being told no option for extension. Retirement is on the line.

If I pursue medical issues I’m keeping under the radar to trigger a med board would I be med held and the wing forced to keep me on orders until evaluation, treatment, med board is complete?

If so, how does this work? What regulation drives this?

I'm not versed on ANG as I'm ARNG. But the below reg should help give you a start. Being over 18 years active is the key. Good luck

10 U.S. Code § 1176 - Enlisted members: retention after completion of 18 or more, but less than 20, years of service

(b)Reserve Members in Active Status.—A reserve enlisted member serving in an active status who is selected to be involuntarily separated (other than for physical disability or for cause), or whose term of enlistment expires and who is denied reenlistment (other than for physical disability or for cause), and who on the date on which the member is to be discharged or transferred from an active status is entitled to be credited with at least 18 but less than 20 years of service computed under section 12732 of this title, may not be discharged, denied reenlistment, or transferred from an active status without the member’s consent before the earlier of the following:

The issue with this is they’ve continued to have me sign sanctuary waivers and ETPs. This is all because they did not properly educate me in the hiring process and set me up to get screwed. This reg you referenced is correct. However doesn’t assist. This is why I need an alternative option. Have to play chess a little.

Maybe reach out to Jag then....guessing you have tried. Being active in the ARNG side gives one access to the fulltime side of Jag. Don't know if its the same for ANG. Good luck.
