CRSC calc for IPEB results

Hey all,

I just received my IPEB ratings 30% dod PDRL and 100% VA. I don't have an assigned attorney to my case, at least not until I appeal so no one has been able to answer my CRSC questions. In fact I've talked to 5 different attorneys and have received 20 different answers but they all recommended I appeal to at least get better counsel and after if I still decide its better to accept the IPEB findings, I can at anytime before my formal board. So quick back ground:

2 of my 5 referred conditions for the MEB/PEB were deemed unfit and not combat related, the remaining 3 deemed fit all fall under mental health and every attorney I talked to agrees I should've been deemed unfit for those as well. The board's reasoning for saying my conditions weren't combat related could definitely be challenged and more than likely won since I have more evidence from medics I deployed with that I didn't think was necessary at the time to get. So here's where I'm trying to decide if the juice is worth the squeeze..

If I appeal I could ask for my conditions to be combat related with more evidence, and for my mental health conditions to be deemed unfit as well, looking at somewhere near 80% TDRL. Is it even worth it to shoot for a higher DoD rating or to get my conditions categorized as combat related, monetarily speaking? (also, are there any tax benefits?)

-- 30% DoD but would also like an estimate for 75%
-- 11 years and 1 month active. Still ongoing.
-- I receive 100% VA and I have a wife and 2 kids that are under 18 years. So from the VA tables - $4072.12
-- Projected approved CRSC -- 100%
-- No other retirement and I did NOT enroll in blended retirement program

Every time I run the math I ended up with $1105 CRSC regardless of 30% dod or 75%. If this is the case, I don't really see a reason to appeal and go to a formal board. I have like ~50 conditions with the VA and IMO all of them are combat related, I understand just because the PEB deemed a condition not combat related that doesn't mean the CRSC board will do the same. Estimate based on the info you provided.

1. Retired pay @30% x 3988 = 1196.40
Retired pay @75% (max) x 3988 = 2991.00
2. Amount of VA offset leaves zero residual retired pay
3. 11.083 AD x 2.5% = 27.71% longevity multiplier
4. 3988 x 27.71% = 1105.07 longevity portion of retired pay, CRSC cannot exceed this amount.
5. CRSC @ 100% from VA comp tables = much higher than amount at item 4

6. CRSC = 1105.07 using your data. Applies to both DOD percentages you cited for retirement pay.
