Hello Veterans, I am an Army O-3 currently in IRR and going through the MEB/PEB process. I have been rated by the VA at 100% for PTSD (combat related) since 2019. I have other ratings as well and receive SMC-K and SMC-S. I have two dependants and a total VA monthly payment of 3886.96. I just signed my NARSUM and have entered the PEB phase. I am unsure what the outcome will be for the DoD rating but I am hoping to get some information to try and determine what my CRSC will be if approved. I spent 9 good years towards retirement in the Army National Guard with one deployment to Afghanistan with active duty time just shy of 1 year.

1. High three: Based on the information given I need some help determining what this is. Unfortunately, I have no idea. Some estimates would be greatly appreciated.

2. DoD disability retirement percentage: I am hopeful for 100% of course since I am rated at 100% for PTSD alone by the VA. I have seen where this is 70% for others rated at 100% for PTSD.

3. Years and months of active duty: 9 years towards retirement in the Army National Guard with one OEF deployment just under a year.

4. VA compensation:
-- percentage: 100%
and
--amount 3886.96
plus
--identify dependents by category and number: spouse with 1 child under 18
---Any SMCs awarded and amount(s) SMC-K in the amount of $103.23; SMC-S is 428.40

5. Approved or expected combat related disability percentage (application was required): Unknown at this time but hoping for 100% approved for CRSC due to 100% VA rating for PTSD (combat related)

6. Do you qualify for another type retirement: No

Thank you in advance for any assistance.

Hello @armyvet73

1. Your high three for base pay is the total of the highest 36 months of base pay (usually the last three years) divided by 36. For just discussion purposes, but not an accurate representation, you could pick one month from each of the last three, add the three rates of base pay and divide the sum by three. Again, that would not be precise.

2. Please provide the DoD percentage you would like for us to use in the computation.

3. Please provide your active duty equivalent. For RC personnel, it is total actual active duty PLUS other creditable points divided by 360. Your total good years is not used in this area.

4. [done]Please confirm that 3886.96 is the total amount of VA comp you receive each month. SMC-S is not 428.40 for anyone. SMC-S replaces the 100% rate. I too receive SMC-S and the amount is 3,592.46 without dependents; yours would be higher. I also receive SMC-K @ 110.31 (not 103.23)
See the following for rates/amounts: 2020 VA special monthly compensation rates | Veterans Affairs <---LINK

5. Please provide the CRSC percentage you would like to be used in the computation. I infer that would be 100%.

Regards,
Ron

Reference item 4...Edited to add:
SMC-S with spouse and one child: 3,776.65
SMC-K: 110.31
TOTAL FROM VA PER THEIR TABLES: 3886.96

What would you recommend to determine my high 3? I am not looking for it to be precise. I am more just hoping for a ballpark to help determine a range the CRSC might fall in. Any advice or help is greatly appreciated.

Hello,

The following is a computation for retired pay and CRSC using incomplete information.

1. Using the current rate of pay for an O-3 over 4 years for pay: $5,847 x 75% maximum DoD disability payment rate = 4385.25 DoD disability retired pay
2. Retired pay reduced by the amount of VA compensation: 4385.25 minus 3886.96 = 498.29 residual retired pay you get to keep
3. Active duty equivalent, 3.59 x 2.5% = 8.98% longevity multiplier
4. 5847 x 8.98% = 525.06 longevity portion of retired pay and maximum CRSC
Note: The combination of residual retired pay plus CRSC cannot exceed the longevity portion of retired pay which is 525.06
5. Max, (Longevity) 525.06 minus 498.29 residual = 26.77 CRSC

6. DFAS would pay in this scenario:
--26.77 CRSC
--498.29 residual retired pay
TOTAL FROM DFAS: 525.06 (same amount as the longevity portion of retired pay)

7. The VA will pay = 3886.96

Some good news to report. I just got a letter from the VA for my DoD percentage and that is 100%.

Another question: I am a O-3 but hit my promotion date for O-4 earlier this year. I thought I read something that promotions are processed before retirement. Can anyone confirm this? Thanks in advance.

Hello @armyvet73 ,

@tony292 had a similar experience with the same ranks. However, he might have been regular Army. You can search his posts for his comments on the subject.

Good luck,
Ron

Greetings veterans, I am now officially medically retired and approved for CRSC at 100%. The CRSC hasn't appeared yet in MyPay so I'll provide my updated numbers here that I can currently see in MyPay and hopefully we can figure it out. I still can't understand this voodoo magic.

1. Your high three for base pay is the total of the highest 36 months of base pay (usually the last three years) divided by 36.

Being a reserve component soldier who deployed to Afghanistan back in 2012\2013 I had no way of accessing what my high 3 was but MyPay shows my gross pay at $5149 which was a pleasant surprise. I had no idea it would be this high.

2. Please provide the DoD percentage you would like for us to use in the computation. 100%

4. Total VA comp is $3937.49

Hello,

You said:

I had no idea it would be this high. COMMENT: The Gross pay you cited is better than the high three; I can determine the high three from the gross pay.

2. Please provide the DoD percentage you would like for us to use in the computation. 100% COMMENT: This will result in 75% on the computation.

3. Please provide your active duty equivalent. For RC personnel, it is total actual active duty PLUS other creditable points divided by 360. Your total good years is not used in this area. I have 1292 total retirement points which includes active duty time. Divided by 360 this is 3.59 COMMENT: So, you want me to use 3.59 active duty years is that correct? If not please provide the active duty equivalent your retirement orders show as "Disability Retirement" 3/4 down the page.

4. Total VA comp is $3937.49 COMMENT: Please provide percentage; amount; dependents by category; ages of dependent children
Do you receive SMC-S or another type SMC? Please elaborate.

5. Please provide the CRSC percentage you would like to be used in the computation. 100%

6. Do you qualify for another type retirement other than disability?

See comments above in bold.

I alsmost forgot to mention.. On the CRSC award letter is states: "PARTIAL CR-SMC: The combined SMC-49 entitlement awarded by the VA is not combat-related. The lesser SMC-01 is payable under CRSC and is effective FEB 21-present"

I noticed under ebenefits that my sleep apnea isn't listed as secondary to PTSD (although it should be) but my ED is listed as secondary to PTSD. I'm assuming this comment above has something to do with this?

My question is: Does it really matter? My CRSC is 100%

I will start work on your case in a few.

Yes, it can make a difference although it appears it will not in your case. SMC-K is about 110. I receive SMC-S which is several hundred dollars more than 100%.

I have been working another case; thank you for your patience.

Ron

Hello @armyvet73 ,

Case.

4. Total VA comp is $3937.49 COMMENT: Please provide percentage; amount; dependents by category; ages of dependent children

5. Please provide the CRSC percentage you would like to be used in the computation. 100%

6. Do you qualify for another type retirement other than disability? No

Estimate.

A. Gross 5149 / 75% = ~6865
B. 5149 minus 3937.49 = 1211.51 residual retired pay
C. AD 3.583 x 2.5% = 4.07% longevity multiplier
D. 6865 high three x 0.0407 = 279.41 longevity portion of retired and ceiling for CRSC,
however
E. The combination of CRSC and residual retired pay cannot exceed the longevity portion of retired pay. Your residual retired pay exceeds the longevity by itself.
F. CRSC is zero due to the large amount of residual retired pay.

Ron

Thanks RonG! I was thinking this might end up being the case but I am really happy with the residual pay of over $1200 which is more than I expected. Hopefully, chapter 61 retirees will get full VA and DoD retirement at some point in the future. I pray for this for all impacted by the unfair current laws.

CRSC for all: I do as well.

You receive much more obviously, than what you would have received with just CRSC.

Good luck and thank you for your kind remarks.

Ron
