CRSC timeline application

Well I hope in my case this to be true. Dfas just notified me my first CRSC payment will be on Dec 1 hopefully within a few days of that we will have retro deposit.
Hi Alex, has DFAS posted a statement on mypay for your expected retro pay? My approval letter for Reconsideration was approved on October 28th and DFAS received it October 30th. I just spoke to DFAS, they informed me of my new monthly pay amount. Now an Audit is next step for me for retro pay amount. My first CRSC claim statement for retro pay was back in Nov 2019. Statement date was Nov 14th and I received retro deposit a couple days later.

They have not posted anything on mypay. Per the ask desk at dfas my approved rating of 90% was established on 10/29 which puts me for 1st monthly deposit on 12/1. I sent another ask ticket today and received word that calculations were done on 11/7 for retro and is now with quality assurance for review before disbursement. They did not give me a timeline for how long it would be with quality assurance but I hope it's not long if they have already done calculations etc.

Hey RonG and friends,
I have been trying to diagnose my situation but I thought maybe I could plug in and get an estimate as well. I got email confirmation my packet was received today but also 3 days ago. In the email it stated expect processing and approval to be 6 months.... So I am not feeling optimistic about a 30 day turn around haha. If I am reading everything right being a ch.61 with 3 years I would be looking at my (YOSx 2.5% ) x $2082 for my award because my crsc award would be larger than my longevity pay? Thank you so much ahead of time for all everyone does here.
1.--DOD retired pay $1,041
2.--DoD disability percentage: 50% PDRL
3. --Active duty years and months 3 years 9 days
4. --VA compensation: 60% w/ Spouse
5.--Projected or approved CRSC percentage by your service: 60%
6.--Whether you qualify for another type retirement and whether you transitioned to the blended retirement system: Not qualified
7.--Did you receive a REDUX/CSB payment?

Hello,

Re: “ If I am reading everything right being a ch.61 with 3 years I would be looking at my (YOSx 2.5% ) x $2082 for my award because my crsc award would be larger than my longevity pay?”

Yes, you are correct.

Nice job.

Ron

Thanks Ron! Couldn't have done it without you I did quite a bit of reading before posting. Since we are on a timeline thread I'll definitely post when I get an approval update. I did try to look up HRC SMS system and was unable to find where an award would be unless it would follow exit orders and DD214 in documents. Thanks again

Hi RonG and others! Sorry to necro this thread, but I’ve been following it for a month or so and I just happened to submit my CRSC packet via email on the same day as the last post, Dec. 3rd. Grats to everybody who also got approved on here!

I received my approval on HRC retiree page (thanks to whoever posted the heads up about how to check for it!) on Dec. 21st for 70% (I’m IU as well so 100%, not that it matters since I didn’t have that many years YOS). I am/will be eligible back to Jan. ‘08 for retro, either under the recent Soto court ruling on 12/17/2021 (for $10k or less) or Paige (ruling pending for $10k or more).

Anyway, I’m in a bit of a potential bind and I’m hoping somebody can advise me…

I served in the Army Reserve before being released from my contract to go Regular Army. My RA DD214 in Block 12c and disability retirement orders both list the same amount of YOS. My total prior active service in Block 12d from attending basic and AIT as a reservist seems to be completely ignored, likewise with my 465 retirement points listed on my DA Form 5016.

My question is: Does anybody know who I need to go through to have this corrected so that my RC time is properly added to my RA YOS? I was hoping DFAS but they were unhelpful when I sent them documentation showing my RC time/points…they just replied to my AskDFAS ticket by telling me the CRSC timeline for review and retro audit. Obviously I’m hoping to have it corrected before they do any of my calculations…

I guess the next easiest possibility would be HRC (praying for that one); I’m just terrified by the prospect that I might have to go to the BCMR to have a simple correction done…

Sorry again if I rambled or wasn’t clear since I’m at my in-laws and having many, many drinks for the holidays. Any help would be greatly appreciated! Merry Christmas and Happy New Year all!

Hello @trip5896

Since you retired in 2008, a local adjustment is not possible in my opinion. You will have to file through one of the correction to military records paths. You might call the Army HRC for guidance on the matter.

The group that filed the Soto case might be able to help you. The best attorney I know with that type of expertise is @Jason Perry the owner of this board.

Generally, DFAS uses the years and months of active duty equivalent shown on the first page of your disability retirement orders under, “DISABILITY RETIREMENT“ about 3/4 down on the page.

Good luck,
Ron

Thanks for the quick reply Ron, I realized after reading it I’d left out that I was retro-retired back to 2008 by PDBR decision in 2018. I’m not sure if that makes any difference regarding your answer, but I’ll reach out to HRC, then Jason, if necessary.

Appreciate it!

That makes a world of difference. There have been several PDBR cases discussed on this forum.

Recommendation: Find the SEARCH option in the upper right corner of this page or any other page of the PEB Forum.
Use "PDBR orders" as your search term initially. You can modify that as needed.

The SOTO DECISION and the "CRSC Glitch"

The "CRSC Glitch" Might Impact Some of the Expected Payments

Extract from 2013 MOAA article:

[start]The FY 2013 NDAA fixed a long-standing glitch in the CRSC payment formula that underpaid (and in some cases eliminated any payment
of) CRSC for combat-disabled military retirees — especially medically retired members. This fix was effective Jan. 1, 2013.

The Defense Finance and Accounting Service will do the new calculations and make
corrected payments retroactive to Jan. 1, 2013
. There’s no provision to provide corrected payments for prior years. [end]

Since the 2013 NDAA did not "fix" the computations for CRSC prior to January 1, 2013, I suspect that some of the veterans who now would be entitled to retroactive CRSC earlier than 2013, will still be precluded from receiving it due to the computation law that remains in effect to this day, for CRSC (prior to 2013).

Mike Parker (maparker) of this board discussed the "CRSC Glitch" in this 2010 article: LINK

So I'm unfamiliar but is it being states that there is a way to receive back pay further the 6 year limitation?

Yes, that is exactly what it means. It being the recent court decision SOTO V United States.

It will likely take DFAS months to ID those eligible and keep in mind the CRSC glitch I discussed elsewhere on this board. Look for Soto.

Sorry for all the misspelling. Very interesting, I know for myself atleast I am waiting on my CRSC to post to DFAS now waiting on that and retro. They currently have me slated to 2016 but I retired in 2013. Is there a link where I could learn or read more about this?

Just to verify one more time. I am still waiting on my crsc award to show up on the dfas side of things. Could I get some clarification whether I should be looking at my high 3 x longevity multiplier or my dod disability retirement if it was 100% x service multiplier?

For instance High 3 $1785x.075
Or DOD 50% $1042. 1042x2= 2084x.075

The computation will include the amount of retired pay, pre-reduction for receipt of VA comp.
