medical retirement or separation?

Hi all, new to the forum. My wife had 4 yrs active duty and then 2 good years in the reserves. She got cancer on active duty and ETS'd in Nov 2006 from active duty, but was rated 100% service connected from the VA for cancer. Cancer spread in OCT 2008 and now her case has been turned over to the med board. Been reading the regs and can't determine if she will be separated with a severence pay or actually retired. She already receives 100% base pay through the VA, so if she is retired it won't make any difference, right (becuase you can't recieve retirement and VA disability at the same time)? So, in this case, it would be in her best interested to just get separated and get severence pay? Does anyone know how to contact the folks who do med boards for the reserves to follow up on this?

I'm very sorry to hear of your wife's condition. I hope everything turns out okay. I'm surprised that she was not put through the MEB/PEB before leaving active duty, you mentioned she ETS'd, was her unit/chain-of-command aware of her condition prior to her leaving active duty?

You are correct, she can't receive both retirement and VA disability pay at the same time.

In my opinion (it is far from the most expert opinion on this forum) I don't think it matters either way. If she receives severance it will be recouped by the VA anyway, from what I understand it would almost be like a 'front' of her VA disability pay and they would simply recoup it until the severance is paid back. I could very well be wrong here, but as far as I know, the only ones with special treatment as far as severance pay are those who incurred or aggravated injuries in a combat zone/during combat.

If she is retired she will be entitled to full medical benefits from DoD, which as you most assuredly know, is extremely valuable.

Does anyone know how to contact the folks who do med boards for the reserves to follow up on this?
I am active duty Army so I can't really offer any accurate information in regard to this question. I would recommend identifying her unit's surgeon or PA and working up the ladder. Perhaps you would be able to ascertain some phone numbers and/or office locations that way.

I apologize I could not be of more help, hopefully another moderator or forum member with some experience on the reserve component side can offer some more useful advice. I hope everything turns out well for you and your wife!
 
If the Military gives your wife 30% or greater, take the retirement. It might not mean much now, but at age 60 you can receive full VA and Full Medical. They no longer cancel each other out. I realize she has cancer, but it may may still be benificial to take the retirement.

Retirement = ID card = all benefits of having ID card. And retirement back pay.
Severance = Disconnected from all aspects of the military = VA will be your only connection. (leaving you in the exact position you are in now!)

And you can collect retirement and VA at the same time. (more on that later).

I was wondering if anyone knew of a way to get back in after a MMRB stated a Soldier was unfit.
I was medically retired at 40% in April 2009. I had 8.2 years on AD. I have been fighting with the VA to get my rating to 100%. Needless to say it has been tough. The Va currently has my rating at 70%. I would not worry about the findings if I were getting concurrent disability, but I am not.
I would not worry about the rating and amount I was getting either - if I had a job. The economy is tough right now.
My question is this: Does anyone know of a way to get a waiver to get back on AD? I could not pass an entrance physical, but my forced medical retirement has caused such a great financial burden on my family that I have to do something. Does anyone have any advice or does anyone know how I can accomplish this?
