SOMEONE PLEASE HELP!!

Tucci,
I did visit my congressman yesterday and spoke to a rep. there. I received a form which has to be filled out and faxed (along with anything pertinent) to the congressman's Military/VA Liason. I will be prepping eveything this week. I've heard 2 different stories so far on replies. The congressman's rep. said I should hear from them in about a month. The other version is from the ART at my squadron that said they had a congressional a few years back and they had to drop everything when notified by congressman's office within 5 days!!--We will see. I'll let you know what happens. And by the way, this is definitely personal for me.....oh yeah, it's good to hear I'm not the only one seeing a shrink---basically advising the same thing---but in truth it's this injustice that's made me angry and focused--and keeping me from a total depression.--Lou

Lou,

When I was a JAG, I sometimes was required to draft responses to Congressional inquiries. The 5 days seems about right for the time that I had to draft a reply. However, I suspect that the difference is that once the draft is completed, it is forwarded to the Military office that handles Congressional inquiries for their review and then, ultimately, signature from the appropriate military official. That takes some time to happen, so that would explain the difference between the response times you were told about.

Mac,
Please feel free to inform Jason of all I have given you with respect to my case. I know he is a busy man but Major Spencer from IG has not given me any hope at all and I feel I must now move forward. I just need to know what he thinks my chances are for success and maybe if available for case.
Jason,
If you see this and want to discuss further I can forward you details by email. Mac has my home email address too. He is also familiar with particulars of my case.
Anyone: IF ANYONE HAS BEEN ON ACTIVE DUTY ORDERS OVER 31 DAYS, BEEN DIAGNOSED WITH AN ILLNESS WHILE ACTIVE, AND IS BEING REMOVED FROM THOSE ORDERS WHILE AWAITING MEB,ETC PLEASE LET ME KNOW. I AM SURE MAC WILL ALSO LIKE YOUR INFO.---

Lou,

Feel free to contact me with your details. I suspect that you are being separated illegally, but in order to really get a handle on things, I would need to look at your documentation. I suspect that based on your review at Wilford Hall (you said they sent you to TX, this is where I assume you went), they came up with some erroneous findings. Hard to say more without a thorough review.

Have you been dropped from orders? What is your current status?

I submitted my case for Reconsideration by the AFBCMR on Sep. 20, 2010 and sent a copy to my Congressman's office the same day. I received a follow up letter from the Congressman's office within a week and a telephone call within the same timeframe. I received another letter from the Congressman's office dated Oct. 18, 2010 with a letter from the Chief, Congressional Inquiry Division at the Pentagon dated Oct. 15, 2010. I called the AFBCMR and they said I should call back in two weeks. I hope my timeline helps.

Doug, have you contact DAV or VFW they have vans that transport patients to Drs.' appointments. Also the only one who speeds up a process is your congressman and the Surgeon General of the Air Force. He was the person who fired the administrator at the hospital were I was maltreated as a second class citizen (DGMC). An IG is a joke, I was told or better yet, I was yelled at by an IG: be quiet, take what you been offered $500.00 a month free of tax and VA medical for life, So forget about it and stop writing letters.

I'm a life member of both organizations and since I'm still on active duty they would not help. I had to pay for ambulance travel out of my own pocket except when I went to the VA for C&P exams. I just testified before a congressional committee today about many of these issues and am optimistic they will take action but it will take time.

Based off of personal experience is it faster to apply online or in person?

I am currently a reservist on active duty orders the last 4 years (with 10 previous years active duty and 2 traditional reserves). 6 months ago I was diagnosed with illness and was told I now had to go through LOD,MEB process. They switched me to medical orders while I awaited the outcome. The Line of Duty determination showed it occurred during active duty status. I am still waiting for MEB, etc but they are taking me off orders!--I did not think this was possible. As I read AFI36-3212 para 8, it states clearly a reservist cannot be taken off orders until "final disposition"--which has not occurred. I've quoted this reg and they are going through with it, though my local medical reserve tech who handles the orders paperwork says I am being shafted!--But he says his hands are tied. WHAT CAN I DO!!??

You may be able to file a IG complaint reference AFI90-301.
