TDRL to PDRL question

Hello all, I am new to the forum though I have been lurking for a little while to find information about TDRL cases. I also just posted this same thread on another forum in error so sorry for that.

I just had a quick question about the transition from TDRL to PDRL.



To give some context, I was rated for 70% DOD service connected disability for MH and was placed on TDRL back in the summer of 2020. I also have overall 80% from VA for my service connected disability and a combo of a couple other conditions. I left the navy through the IDES process and because I hadn't been in for very long, I chose the VA payment because it would pay more than the DOD retirement pay. I had been checking in and waiting for my re-evaluation for a while and they finally scheduled it for early February. I finished my appointment and they sent me an email today which states that I would be moved to PDRL with my DOD percentage being lowered to 30%. I am happy about this because as far as I know, it allows me and my family to keep Tricare and also will not affect the current VA payments that I receive.



My question now is, is there anything else that I need to know about going to PDRL and should I bother to contact a DOD lawyer before I accept these findings? Any advice, or anyone else's experiences are also appreciated. Thank you.

Lot of time, it doesn't. You might get two re-evals in a 36 mo period for that reason. All depends on what the doctors say.

Also, interestingly enough, and especially for MH, if you are regularly getting treatment for your condition at VA, PEB can access those records and potentially make their determination without sending you to a separate reevaluation.

Depends if your outside provider is putting records into the VA records management system. DOD/PEB doesn't have access to civilian records, but they have access to VA records through the new MHGenesis system.

You know, I honestly don't know that. It's a good question, especially if you are seeing an outside provider at VA recommendation/direction. I'd ask your VA case manager/PCM. Can't hurt to ask.

It is an awful system that creates perverse incentives, but it is the system we have.
 
What percentage would you say is members TDRL for MH conditions placed on PDRL? Thanks @RetiredColonel-MikeT
As @PERS-95 said "it all depends" but if I were a betting man, I would say in the 75-80% range, higher if you're strictly talking PTSD, my swing on that would be closer to 90%, maybe higher. Mind you, a chunk of those improve enough where the PTSD is no longer unfitting, but they still have other conditions that still retire them. Of the remaining 20-25%, 5% don't retire due to non-compliance issues and 10-15% improve enough but do not have other underlying conditions to keep them at 30% or more and 5% (or less) are found FFD. Truly just a guess on my part, but I would love to look at the data. When I was a PEBLO, at around the 5 year mark, I did a data review as to the breakdown of dispositions. It's too bad that was 10 years ago now and no longer have that report, I couldn't even guess what was the breakdown between PDR, TDRL, SWSP, SWOSP, or FFD. But I can tell you those last 3 dispositions made up less than 20% of my cases, and I was definitely in the 500+ range over my seven years.
 
I just have a question about your email stating placement on PDRL. Did you receive officials orders that state you’ve been placed on the PDRL?
I’m current trying to renew my ID and only received orders stating my removal from the TDRL and not the official placement on PDRL.
I got orders removing me from the TDRL and permanently retiring me in Dec 2022. I was Army though. The orders stated I was removed from the TDRL and then permanently retired.
