Hey brother I just got my money tax free. I requested a congressional inquiry. I spoke to my representative secretary las week and sent the inquiry last week Monday and I woke up this morning and the money was in my account tax free. I spoke to dfas last week and they hadn't even touched my orders yet.

My is Marcos Rubio of Florida. I went to webpage downloaded the Privacy Act Consent Form, filled it up, signed it and emailed back to him. The next day monday last week I had a call from one of his aides and she summited the inquiry that day.

Yes. My injuries are combat related and dfas was supposed to tax my severance and then I was supposed to claim the tax back but they gave me all the money today. I am not sure if it's because I summited a congressional inquiry. I just received a call from senator Rubio's aide saying that issue was taken care of.
So from reading this post folks that are direct MEB and separated (not TDRL) can expect their $$ in two to four weeks? That is not too bad I suppose if it actually happens like that. Also, as I understand it, if our injuries are service connect but non battle related then the severance pay WILL be taxed and I cannot claim that back. Correct?

If your injuries are service connect and you have a va rating for those injuries and those injuries are the one found unfit during the MEB your will be taxed but your will be able to get it back from dfas if is before December and from the IRS if is after December. Either way you'll get the money back if you have a va rating for those unfit injuries found during the MEB/PEB process. Now because yours are not combat related the VA will recoup the severance from your VA check.... let's say you have 60% combined rate but you were found unfit for ptsd and given 20% by dod and separated with severance. The va gave you 20% as well for PTSD. So they will recoup that 20% from your VA check every month until the severance is pay back. Get on dfas website and read about it. Hopefully this helps.
I hope none of you are waiting on anything from DFAS. They are way behind schedule on everything due to COVID-19. My orders were received by DFAS back on Feb 6th and They have done nothing with them at this point. I have a Congressional inquiry pending now and 2 Ombudsman from Ft Bragg working it and there is still no change. DFAS put me under a C4 hardship to try to expedite the process and still nothing. Anyone waiting on DFAS might as well realize we are at the mercy of an organization that is not held accountable by anyone.
I have not received my severance either. DFAS have received my orders 29-Jan-2020 and still nothing. It looks like is going to be a long wait, they said 30 to 60 days but most people say around 90 days.
Quick question: Can the VA recoup monies from my VA payment of 3602 per month if my unfitting conditions were rated 0% on my 199 but my other service connected conditions are rated 100% P&T? I am set to receive a Severance on 1 May and wanted to ensure this will not change my monthly payment from the VA.

Generally, if a Veteran received disability severance pay, VA must withhold from his/her monthly compensation an amount equal to the monthly compensation payable for the disability(ies) for which the Veteran received disability severance pay. VA continues to withhold this amount until it has recouped the amount specified in M21-1, Part III, Subpart v, 4.B.2.d.
Important:
The monthly withholding may never exceed the monthly amount of compensation payable based on the initial, compensable rating, as defined in M21-1, Part III, Subpart v, 4.B.3.c, that VA assigns the severance-pay disability(ies).
If a Veteran has multiple, severance-pay disabilities, each rated 0-percent disabling, and VA assigns a 10-percent disability rating to them under 38 CFR 3.324, no withholding is necessary for these disabilities until VA assigns a compensable rating to one or more of them, individually.
Withhold the additional benefits payable because of application of the bilateral factor if
the initial, compensable rating included application of the bilateral factor, and
entitlement to the bilateral factor was based exclusively on severance-pay disabilities.

As I mentioned, this is not my area of expertise. However, my interpretation of the reference I cited is that: none will be collected. See the bold part of my initial reply.
I checked with my MSC and also Soldier Counsel. I am in the same boat. Your pay VA pay should not be decreased. By law, the VA has to pay you everything that you are entitled to. The only situation where the recoup applies is where a condition obtains disability pay twice. They will recover that. But if condition is only receiving compensation for VA and not DoD rated disability, legally they cannot recoup that.
I have been waiting for 6 and half months for my severance check. ( Still waiting) Dfas has lost my paperwork at least twice. Then I have to call headquarters to resend my discharge orders. I got tired of calling dfas and I found a good contact email with someone in support. If you're interested let me know.
