Would an arrest record support a VARR?

Got my IPEB results back 70%/90% for PTSD. Considering submitting a VARR for 100%, utilizing reckless driving/speeding arrest records and possibly sleep study results as evidence. Is this a good idea?

what does your attorney say?

Total occupational and social impairment, due to such symptoms as: gross impairment in thought processes or communication; persistent delusions or hallucinations; grossly inappropriate behavior; persistent danger of hurting self or others; intermittent inability to perform activities of daily living (including maintenance of minimal personal hygiene); disorientation to time or place; memory loss for names of close relatives, own occupation, or own name.

this is the criteria for 100%. Hard to say if arrest records would be enough. It would be better if a doctor said that you can’t remember your own name, you don’t know what time or place you’re in, you’re in danger of hurting yourself or others, etc.

if more than one of these are true and well documented, then I’d say go for it. But if they aren’t spelled out clearly in your medical records, and if it’s just one of the criteria, then it’s a stretch.

Few individuals meet the criteria for Total Occupational and Social Impairment. Your ability to reason cuts against your argument. Let a lawyer talk for you.
