YetAnother Admin Action/ MEB Question

**Update**
17 May 12 - I received my Personal hearing with CC, he didn't speak at all, myself and ADC spoke, and we were offered to submit any additional documents, of which we did.
24 May 12 - Informed in writing and had to sign CC's intent to continue with the Demtion Action
5 June 12 - Called VA 1-800 - Have informal ratings mailed and faxed - Immediately request special addendum to the Demotion Package

7 June 12 - OFFICIAL Results from PEBLO - Sign my paper work - gets mailed off - 1st Shirt tells me CC has decided that my official document's cannot be allowed in the Demotion Action package as "being found unfit for duty does not have any relevance to the demotion action" WTF So unfit finding doesn't come into play for failing FITNESS???? - ADC called gets same answer, tell the 1st Shirt we do find it relevant and these items were postmarked 2 and 4 May - so if we'd had em we would have added em in rebuttal, therefore we're pressing the legal office to allow this in the package while they have it and are reviewing. CC orders shirt to call Legal and tell them under NO circumstances are we/they allowed to add anything to that document. -

12 - 14 (today) June 12 - Demotion Action still at legal - no action taken yet. Once this is forwarded with or without my Findings, and signed AF 356 and all that I will be notified.

I seriously hope that my CC doesn't have to do anything on my behalf with regards to Admin Sep, nor can I see how he can at this point from my understanding it's up to SecAF offices to make the determination. My CC's very own letter in my MEB packet stated he wanted me returned to whatever limited duty capacity I required so I could then be Admin Separated from the Air Force for failing to meet fitness standards, I do not see him turning around on this. Especially considering I've went to him 7 months in a row at the beginning usually of each month about having my duty day run in a consecutive manner vs 4 hrs split over 2 separate shifts, and have always been denied. And as well as the above mentioned letter he already wrote. In my IPEB findings they did state quote my CC's own account of how disabled I was, but left out his opinion, and only showed the facts.

ktk2 We'll get there, just keep documenting and pressing everyone you can. On one positive note I got a call from Social Security today they need me to come by tomorrow to sign my medical release (thought I already had but guess not)

I know it's just frustrating dealing with the situation! I only did 3 yrs will I qualify for social security since I'm being medical retired

- MY SSDI Update -

I actually had a great meeting today with SSA about my SSDI claim, they required my signature for medical records retrieval. Well I went in gun's loaded so to speak, I had a 3 ring binder divided into 4 parts with all of my info organized. My MEB packet, VA/PEB Official Findings including AF Form 1108 and AF Form 356, Additional hospital and surgeon/physical therapy discharge notes with Pictures from MRI and latest CT Scan Pre-Post Op, and Finally Every AF 422 or 469 DLC Profile outlining every restriction and condition. Additionally a table of contents, and Letter requesting my CC NOT be contacted under any circumstance. When the nice lady asked me why, I elaborated on my situation, and read for her my CC's MEB letter about being returned to duty so I could be kicked out, and I constantly abided by my profile while in the office, with my ups and downs from sitting, of which she stated that she is obligated to make an observation of the interview and that it was apparent I was in distress the entire time. She also was keen to point out and make sure to document that I was wearing a back brace and required a cane to walk. This was supposed to be a 5 minute signed and be on my way, until she saw my documentation and when clarifying answers to my web application it was clear my condition should have no hangups she could for see. She was very sympathetic and the entire 1 and 1/2 hrs I was there (not 5 minutes) I kept mentioning the wounded warriors site on SSA.gov and publication no 05-10030. She again stated she wasn't aware of the pub, but the wounded warriors program she knew about. I even told her about the 1hr + webinar video / powerpoint and that it's very informative in what represents qualifying factors, and that I wouldn't have been there unless I met those criteria. Very helpful, when this is all over with and I can start naming name's - her's is # 1 on the list for helpfulness so far!!

Also had a meeting with my ADC today and they submitted a request for extension on the Rebuttal statements, along with a concur / non concur from the CC - to show that we made every attempt to get this noted before the commander and redress the issue before it goes up further thru the process to the demotion authority. So that when we appeal we have this "ammo". Apparently the Legal Office, was quite disgusted by the fact that my CC was not allowing this, and felt that the only way to properly do it was to ask for this extension, and show we did everything we could possibly do to get this in. SO - things are looking better on that front - here's crossing my fingers!!!!

I find out Monday what admin actions I have against me which sucks seeing how I had already signed of in concurrence with the decision that DOD made to medical discharge me, my mental state is so jacked up at this point I can't tell you whether I'm going or coming

I'm a little lost on on the Admin Action....is it related to MEB/PEB decision? Now, I mean that in an honest no shit sorta way, as in my scenario I failed PT test due to not being able to PT at all and Dr's excused me except military didn't "agree". Basically if the admin action is for anything un-related, or directly a result of your conditions outlined in the MEB/PEB summaries they can/will be served. Don't remember the AFI #, but I know i've read in one that has wording in it that administrative action continues and should not be placed on hold except under certain situations, and MEB is NOT one of those.

**UPDATE to My situation**

SO as expected my commander disapproved an extension for more time to submit additional rebuttal documents to the original package. This decision was then forwarded to the legal department, and they included the disapproval mfr in the demotion action package. SO, the funny thing is all my issues with having had the official word from IPEB and results from VA in and signed as of June 7th, 2012, and that this information was received on base on May 4, 2012, were in the MFR request - just with the attachments being the actual AF Form's signed showing I agreed with the decision. I think my CC is going to be a little upset when he finds out that it's included but not like I really care, I've been more than amicable in this situation to the correct order of ops within my CoC. Another funny thing is, I was called into work last saturday evening to come fix a problem with one of our security systems, Not my Job, nor do I have access to the system, guess what I identified what was wrong, and what it would take to fix, and I was the only one they could get a hold of out of 6 other people. Only reason I went is the (M)Sgt that called me is a good friend and has sought to help me throughout my ordeal and he knew he didn't want to call me but he was in a bind as to not have a security incident, and had to exhaust all avenues before calling me. I just told him I WANT IT KNOWN all the way to the TOP who came in and fixed it!! LOL anyways, things are looking closer to ending.

Anyone know how long the SECAF dual action decisions and Grade Determinations take? are they done at the same time? I have not filled out ANY documentation showing I was a SSgt/E-5 previously that I'm aware of...maybe I have...now that I think about it i'll have to go back and look.

Well you should know what's in your PIF...in fact you can request a copy of it or go and look at it at least. If it's been in there for a while and they're just NOW punishing you based on your Medical stuff, that seems a little retaliatory in nature. But above all else again, only you know what's in there or should be in there might be a better answer. If you have LOR's and LOA's or any other NJP that is unrelated to your medical condition, they should have been processed in a timely manner, and you may have a basis to fight them, additionally if they've been sitting on things waiting for your MEB ruling to come down and just NOW deciding to punish you then you may have a case to fight as well.

Like I said, you know what's there so be prepared!

I always wanted to transfer from Army Aviation to the Airforce and fly for them, but after reading stuff like this, I am glad I stayed in Army Aviation. As a test pilot, I wasn't bothered too much. But I really hope you guys fighting this crap in the Airforce get some positive resolution soon. I think its very sad that a commander would put an airman through this crap, even after medical issues are an obvious cause and a medical decision was already made. Now it just seems like revenge and I don't understand how this is legal in any way. I would have called my congressman long ago.

Right now, even more than ever, it's all about the dollar (or lack thereof), and tools like force shaping, using PT testing to edge people out and requiring boards for promotion from Lt to Capt (never done before, has always been automatic) just prove the corporation mindset even further. For the most part, however, rated flyers are left alone unless we get sick.

I was left alone for the past 14 years as both an aviator and an aircrew member. It wasn't until I was a huge asset as a test pilot that everyone started to freak out. That was one of the reasons my PCM and my Nurse Case Manager were trying to move me to the WTU early on so I could get out my units issues. That never happened, but luckily now that my unit is on a 12 month deployment to Afghanistan, my PCM requested I no longer have responsibilities. It has been very nice considering I might put my uniform on once or twice a month if even that. Cleared CIF 4 months ago so I now really have no job in the Army to perform, and its unlikely they would take me to do a desk job with all my medical issues and medication requirements. I feel for all those who unfortunately have commands with little sympathy for those going through the MEB. I think a lot of it comes from perception. I know for a fact that there are those who abuse the system and suddenly claim medical when punishment is around the corner. They make a bad name for us all and I would hope nobody on this forum falls into this category. I see the type regularly when I am at medical appointments, awaiting my turn at the pharmacy, on elevators at Tripler, etc. I've heard it all and because of this very real situation, units are starting to wise up and become suspicious of those who are up for reduction in rank, UCMJ, chaptering soldier, etc and suddenly visit the TMC and come back with a profile and a recommendation for an MEB. Try to put youself in the commands shoes and I'm sure a lot of you leaders would feel the same way.

It's because you can have dual actions going on simultaneously. If you are in an MEB, that takes precedence over anything else, except certain UCMJ actions. So your command can recommend whatever he wants. It wont get very far though if you are going through an MEB. Just be aware, being recommended for an MEB and actually being in an MEB are two different things and if no action has started on your recommended MEB, time is working against you.

Awww, I see I missed that in your post. Sorry about that. This seems to be occurring quite a bit recently. Only recommendation I would have is seek legal assistance. Or is there a way for you to talk to your commander and explain what this will do to your life after the military?

I've tried that and got nowhere. So now I have to wait for base commander to decide whether or not he agrees with the squadron commander of if he's going to allow my MEB to finish out..... this is so draining sitting in this office day in day not doing anything just because a few people sat behind a closed door and decided that wanted to be nasty about the type of discharge I was getting ready to recieve.
 
That's sad it's like this though I've been preparing myself to get out and now I'm just stuck in limbo just because. that's not right

Well it's "official" - My first shirt called me tonight *30 Jun 12* at 7:30pm to inform me he had checked his email and that the General (Demotion Approval Authority) had agreed with my CC to demote me yet for the second time. I have my unfit finding back and signed for not appealing the IPEB results, so this is just assinine. I blew up on my shirt for about 40 minutes how this wasn't right, he's like I'm with ya...but I told him no you're not no one in the chain of command is. If Anyone was on my side then this wouldn't have gotten to this point. He's like well there's always the AF Board of Corrections....I again just got angrier and angrier on the phone to the point I apologized and told him I wish he'd just notified me on Monday, especially since No way i could find a seamstress on Sunday, and the fact that this is a bunch of BS yet again, that I'll have to fight now 2 rank reductions. He's like well I wanted to give you some extra time to get your appeal ready. Again, To this I said the appeal, it's the same fucking thing i've been preaching since January 2011 - you know that and so does the CC - whatever I'll see you Monday after my 2 appointments and that'll be around 11am or there after.

God almighty... I have been an A1C for over a year and a half now...(supposed to be a SrA long time ago Kiling me! And you!) I am trying to put it on now, before my Composite DLC runs out but the CC is taking his time signing my EPR which is my golden ticket.

How are they able to take all that pay from you? I get the "rank" but the pay I dont get. I was under the impression that you have to be able to live the same lifestyle you were. I think there is a finacial hardship form for this type of thing. Where is your MEB at? Are you waiting for C&P appts? Or what? You signed your unfit letter, when? Your loosing rank for PT correct? Have you gotten a Full Composite DLC before? If not talk to the DAWG chairman/PCM/cheif of areospace medicine. See if you can get one. If they say no, and you cant honestly PT or pass a PT test because of your injuries talk to the paitent advocate and try to set up a meeting with the Hosp commander. They can grant you one if you fight it....Fight this fight that fight everything. I know it gets old.

I assume you have, but have you done an IG complaint, (Which I wouldnt do) or contacted congress? If you havent you should! Give them a Call talk to an Aid and see if they will hear you out. This is crazy! have you asked your PEBLO about a fast track PEB/MEB yo get you the fuck outa dodge!

Whats your career feild? I cant remember. What base are you at? I am trying to get a scope of WTF is going on.
